Jury in Kyle Rittenhouse homicide trial asks for additional copies of instructions, including several pages focusing on self-defense

The jury in Kyle Rittenhouse's murder trial asked for extra copies of jury instructions, including pages that offer instructions on self-defense, CNN reported.

The charges include first-degree reckless homicide, first-degree intentional homicide, attempted first-degree intentional homicide, and two counts of reckless endangerment.

Rittenhouse, now 18-years-old, pleaded not guilty to all of the charges, claiming self-defense in all three cases.

The judge gave the jury 11 additional copies of pages 1-6 of the jury instructions, according to CNN.

Of those six pages, two outline self-defense instructions, CNN reported.

One page focuses on "crimes requiring intent to kill" and the final two focus on the charge of first-degree homicide for Rosenbaum's killing.

I may be wrong but I take this news as positive for Kyle.

Reasonable doubt has been established. The jury pouring over the self-defense instructions should help.

Damn, sounds like at least one juror thinks using a gun while being shot at is reasonable. So now it’s down to if they come back hung or not guilty.

I agree. As a former juror on a number of cases, I think this is definitely a good sign.

the jury only took 4 hours in the O.J. case

possibly a hold out

1. prosecution implied that having a gun is itself provocation;

2. tendered an “enhanced” photo to argue that Rittenhouse pointed it at the first of his assailants and, in that instance, was provocative and lost the right of self-defense; and,

3. that Rittenhouse should have allowed himself to be beaten up by the second assailant and, so, using deadly force in self-defense in that instance wasn’t justified.

The first argument is laughable. It’s an emotional appeal to gun-control freaks.

The second argument is weak. The enhanced photo doesn’t show a raised gun, and it’s an enhanced photo, one with pixels added by a computer program. And, so what? The rifle might have been raised momentarily, but this doesn’t constitute provocation. Provocation, as would lose the right of self-defense, would involve aiming a deadly weapon at a person or verbally threatening the person. The second argument is basically the first argument joined by a fuzzy photograph.

The third argument is back to laughable. The prosecution couldn’t prove that Rittenhouse didn’t reasonably fear for his life or serious bodily harm, because people have been beaten to death and into vegetative states and such by being beaten by clubs of various sorts.

There’s also the matter of overreach. The prosecution charges Rittenhouse with lots of things, from trivial to very serious, most of the charges having only flimsy evidence. They’re throwing mud on the wall in the hopes that something will stick. The judge threw out the two trivial charges, and should have also thrown out several of the serious charges based on lack of evidence.

To my satisfaction the only charge with any evidence concerns whether Rittenhouse lost the right of self-defense due to provocation; and, that charge is based on a wild interpretation of an enhanced photograph. And, there are procedural grounds to object to allowing that enhanced photograph into the courtroom.

The prosecution had no case. Agreed - Rittenhouse was not pointing the weapon at Ziminski. But, the jurors might believe he was pointing it.

Still, it shouldn’t matter because then Rittenhouse was running away from Rosenbaum, and he didn’t shoot until Rosenbaum lunged for the gun.

A bit surprised the jury didn’t reach a not-guilty verdict right away.
