PolitiFact and Facebook have been slammed for an August 2020 'fact check' that claimed it was false to say it was 'perfectly legal' for Kyle Rittenhouse to carry his AR-15 rifle at the Kenosha riot, after a judge tossed out his firearms possession charge on Monday.
The judge in the Rittenhouse case yesterday threw out the gun possession charge, ruling that the law is written in such a confusing way that it allows for the interpretation that 17-year-olds can carry guns if those gun barrels are shorter than 16 inches.
'I‘m still trying to figure out what it says, what is prohibited,' Judge Bruce Schroeder said. 'Now, I have the good fortune of having some experience and a legal education. How is your ordinary citizen supposed to acquaint herself with what this law says?'

No, it actually is written so it allows 17 year olds to carry long guns if those gun barrels are LONGER than 12 inches.
Leave it to the Daily Mail to write a story about inaccurate media reports and add even more inaccuracies.

It was within the law because the prosecution presented no evidence to the contrary. The rifle barrel was never measured.

It begs the question why the prosecutors brought that charge at all. All they had to do was open a book and then break out a tape measure.
Here's the main link -- 948.60 Possession of a dangerous weapon by a person under 18.
And here's the specific weapons stuff -- 941.28 Possession of short-barreled shotgun or short-barreled rifle.
Here's the part of the main section that links to the subsection about rifle length, "(c) This section applies only to a person under 18 years of age who possesses or is armed with a rifle or a shotgun if the person is in violation of s. 941.28..."
Here's what 941.28 says about rifle length: "941.28 Possession of short-barreled shotgun or short-barreled rifle....(b) “Short-barreled rifle" means a rifle having one or more barrels having a length of less than 16 inches measured from closed breech or bolt face to muzzle or a rifle having an overall length of less than 26 inches."
Kyle's rifle was longer than that. Therefore he was not in violation of 941.28, and therefore not in violation of section 948.60.
