Today, New York health care professionals have asked for emergency relief from the U.S. Supreme Court in their lawsuit against Governor Kathy Hochul, Department of Health Commissioner Dr. Howard A. Zucker, and Attorney General Letitia James against the state’s unlawful COVID shot mandate. The health care workers have alternatively also asked the High Court to review the case. The case goes to Justice Sonia Sotomayor for review.
The plaintiffs appealed to the Second Circuit Court of Appeals and the U.S. District Court for the Northern District of New York.
The “Mandatory COVID-19 Vaccination Policy” applies to health care workers in all “hospitals, nursing homes, diagnostic and treatment centers, adult care facilities, certified home health agencies, hospices, long-term home health care programs, AIDS home care programs, licensed home care service agencies and limited licensed home care service agencies.” On August 16, 2021, Governor Hochul announced that the state will now require health care workers to accept or receive one of the three currently available COVID-19 injections to remain employed in the healthcare profession. The deadline for them to become fully vaccinated was Monday, September 27, 2021, for hospital employees and October 7, 2021 for other facilities.
Though Governor Hochul’s announcement initially indicated that there would be “limited exceptions for workers with religious or medical reasons,” the State’s Public Health and Health Planning Council eliminated an exemption and accommodation for religious reasons on August 26. In fact, under the state’s rule change, the only exemptions permitted in New York will be for medical reasons documented by a physician or certified nurse practitioner.

NY doesn't want to accept the concept of religious exemption?
The right way to "market that" may be:
"NY is seeking to overturn the 1964 Civil Rights law that Martin Luther King gave us".
People also act as if it’s OK for companies to judge if their employee’s religious beliefs are sincere enough for an exemption. Basic Christianity teaches only God can do that. If an exemption is denied the employee is pretty much being told by management he’s going to hell.
When covid hit I, a mechanic in a steel mill was deemed essential and didn’t miss an hour of work. Now that the world is returning to work they feel I need to get vaxed to continue working.

Yes. And I’m pretty sure that the law is written to be clear that this is not a Theology contest. If one is (let’s say) Catholic, and you oppose the vaccine, it is not an acceptable “counter-argument” to reply “The Pope is OK with the vaccine, so you are wrong”. Your employer is not to judge if you are a “good Lutheran” or a “good Baptist”. If you have a “personal, sincerely held belief”, that is supposed to be sufficient.
But it’s the 21st century and there are no rules.

Given the record of our current Supreme Court, my guess is the majority of Justices would simply say that the Healthcare Workers have NO STANDING!
Does this apply to self employed HC workers?
Those with natural immunity should not take the injections. No transmission risks, no benefit. Even those with the SARS 1 have immunity to SARS 2 have immunity and likely very long lasting.
I’ve read that when you ask for a religious exemption you are involking your right to an exemption, and once you do that there isn’t even a decision for the employer to make.
