A U.S. appeals court on Friday affirmed its decision to put on hold an order by President Joe Biden for companies with 100 workers or more to require COVID-19 vaccines, rejecting a challenge by his administration.
The 5th U.S. Circuit Court of Appeals in New Orleans upheld the ruling despite the Biden administration saying on Monday that halting implementation of the rule could lead to the deaths of dozens or even hundreds of workers.

Yup. Joe will only officially ignore a ruling from the SC.
Anyone have an idea how this will (or not) affect federal contractors?
ducttape45, thanks for the good news ping.
I'm more partial to the Ronettes though!
Set me free, why doncha babe 🎶
I think SCOTUS review is inevitable because loser has a right to appeal, and this case bypassed Distrcit Court.
You should read the opinion. SCOTUS will have to twist itself into more of a pretzel to uphold the OSHA ETS.
No direct effect.
Plaintiffs in those cases will likely cite this case though,m and the rationale in this case (some of which is beyond the OSHA mandate, and gets to federal power in general) may persuade courts hearing the contractor cases.
Hope those cases get heard quickly. Time is running out.
Let’s hope the good news continues, Lord knows I’ve been doing a lot of praying this holiday weekend.
Agree with other posters, this doesn’t address the mandate foisted upon federal contractors, HOWEVER, there is a court case in FL on Monday at 9:00 AM filed by Liberty Counsel. THAT’S the one that will affect many like you and me. BE IN PRAYER!!!!
Was going to NOLA for Mardi Gras 2022 but since they have a vax mandate, no way!
I wouldn’t either!
Although if SCOTUS does not listen to it, then Biden’s mandate will be struck down.
I think SCOTUS has to take the case, otherwise defendant is denied right of appeal.
I expect SCOTUS will hold that OSHA is out of its lane, but will not agree that vax-mandate is off limits to the feds, being a state police power.
Rather stunning. And on a Friday, no less!
That is a 22 page *itch-slapping of Deep State.
Wow.
Praying hard!
There are I think two other federal vectors. One is the mandate to facilities that take Medicate funds. IIRC, “CMS” is the fed agency pushing that mandate.
The other one is the mandate against those in the military.
There are also state mandates, as well as private employer mandates. Probably a thousand or more vectors of government action against personal choice on this vax.
critical to note that the Mandate makes no serious attempt to explain why OSHA and the President himself were against vaccine mandates before they were for one here
Footnotes too! Brought a smile to my face more than once. Genius to quote Roberts ...
The Commerce Clause power may be expansive, but it does not grant Congress the power to regulate noneconomic inactivity traditionally within the States' police power. See Sebelius, 567 U.S. at 554 (Roberts, C.J., concurring) ("People, for reasons of their own, often fail to do things that would be good for them or good for society. Those failures-joined with the similar failures of others-can readily have a substantial effect on interstate commerce. Under the Government's logic, that authorizes Congress to use its commerce power to compel citizens to act as the Government would have them act.");
