With prejudice, meaning no retrial.
Why are they only asking for a mistrial?? From what I’ve read, sounds like they might could ask for a directed verdict of not-guilty or a dismissal with prejudice.

Based on my extensive experience watching TV crime shows, I’d say that is grounds for a mistrial.
It appears that the Prosecution is deliberately trying to invoke a mistrial because this one is going so badly.
A mistrial will give the prosecution a second chance at prosecuting Kyle, and erase Grosskreutz’s prior testimony that Kyle didn’t shoot him until he pointed his own gun at Kyle.
Defense called the Prosecutor out on this ploy, and wants a mistrial with prejudice so that there won’t be another trial.
I think the prosecution wants it too, based on their actions.
Why would they do that, when they’ve had a lot of things swing their way?
That’s why they put him on the stand. They wanted to get his story out there, humanize him, and then let the prosecution screw up yet again, then launch that mistrial missile they had waiting in the wings.
A mistrial is preferred because of the possibility that the jurors would be afraid NOT to convict. There are already vague threats to the jury and people taking their picture.
Seems as if judge has sustained prosecution’s objection to defense motion for mistrial.

A mistrial is without prejudice. The defense has presented a stellar defense with a great judge presiding. They cannot top this and there is no guarantee of getting the same judge in a new trial. Make the motion for a directed verdict and, if that fails, let it go to jury. And if that fails, use all the errors that would have warranted a mistrial on an appeal to overturn the verdict.
Although I now have serious questions about Lin Wood, wouldn’t he have had fun with this trial?
The defense always asks for dismissal or mistrial. Doesn’t mean they get it.
Every single person involved in bringing this to trial in the first place MUST be imprisoned.
They should have asked for case to be dismissed right after the prosecution finished. They did not make a case. They could only go downhill from there.
