HARRISBURG, Pa. (AP) — An order by Pennsylvania’s acting health secretary that requires masks inside K-12 schools and child care facilities was thrown out Wednesday by a state court that said she lacked the authority.
Commonwealth Court sided 4-1 with the ranking Republican in the state Senate and others who sued to challenge the masking order that took effect in early September as a result of the coronavirus pandemic.
The judges said Acting Health Secretary Alison Beam’s mandate did not comply with the state’s laws about reviewing and approving regulations and was adopted without an existing disaster emergency declared by the governor.
The state’s disease control law does not give health secretaries “the blanket authority to create new rules and regulations out of whole cloth, provided they are related in some way to the control of disease or can otherwise be characterized as disease control measures,” wrote Judge Christine Fizzano Cannon, a Republican, for the majority.

There is a dearth of understanding when it comes to properly ordered authority these days. Nothing new.
It’s better though to bring any mandates down to the school board level. Speaking as a Californian whose teen is still under a statewide mask mandate.
Governors who make statewide mask mandates are providing cover to all the school districts.
At least school board trustees can be recalled or voted out if they refuse to make masking optional. Obviously the recall of Newsom didn’t work—but at the individual district level, communities have more power. Some may choose to continue the mask mandate, some won’t.
What CA needs to do is wrest away Newsom’s emergency powers. Unfortunately, even if we did so, the CA legislature would likely still continue the K-12 statewide mask mandate. But at least they’d be on record of having to vote for one, and could be individually voted out.
Kids in Philly will be masked until they graduate and /or turn 35 y/o, which ever comes first.
Note to parents who, for whatever reason/s can’t/won’t pull their kid/s out of publik skrewls...
Audit the expletives-deleted.
Look for ghost students, padded payrolls, stolen equipment, bogus expenses...
You get the idea.
Put the screws to the skrewl boards. Keep the ******** too busy and too scared to **** with your kids.

A day or two ago, Wolf announced that he was going to graciously take the boot off PA students’ necks in mid-January. I was wondering at the time “what is coming that he knows about” because not once in this entire pandemic response has he eased up on a restriction without walking all the way up to the line and seeing how far over he can lean without getting smacked.
Now I know.
Also... I don’t have great faith that this will be the last we hear about this. The PA supreme court is still packed with Wolf loyalists and Wolf hasn’t backed down or apologized for a single thing he’s done yet, and considering he banned haircuts and golf but legalized drinking and driving as ways to stop covid, he’s got a lot to account for.
Will,the gov tell the schools, like Biden told,business, “just ignore the ruling”?
This is good news. I believe many suburban school districts will unmask quickly.
