Future sociologists will have a field day studying winners and losers of "harassment" charges after the sexual revolution. It's OK for alpha males to be sexually aggressive, exposing themselves and demanding sex, (e.g.,Bill Clinton), groping women, (e.g., Bill Clinton), etc., but beta males get arrested for comments or "unwanted communications", by, of course, alpha males. Law does not explain the difference in treatment. Preferred classes of people do however.

Arresting and referring to prosecutors is police job. Prosecutors decide if enough evidence to bring to court. At least that is how I understand it.
