Realistically, we'll need to win one that also is upheld on appeal to a circuit court. But still, we only need one win. At that point, unless SCOTUS acts, the injunction will be in effect for the entire country.

If they were truly *monitoring trends*, they’d see this is a nothingburger....and, we’re merely seeing breakout infections, from the “vax”d.
Ohio employees need to argue this with their companies, who need to pressure politicians to pressure Biden to pressure OSHA to write rules that everyone be tested.
Testing all people regardless of vaccination status will probably never be done, as the results would be “unwelcome”.
I believe that is one reason why Japan’s infection rates have been low - they do not so the level of testing that is done in the US, Canada, etc.

Re: 42 - I was just talking about this with someone about 1/2 hour ago - was wondering when they would just drop the 100 employee minimum to 5-10 employees.
Now we know - it’s coming. My guess is that this may be a preemptive strike by OSHA in preparing for some legal challenge based on the 100 employee minimum.

A: OSHA was under orders not to further anger voters at Democrats prior to the election.

The courts have been very supportive of all the covid mandates.
No doubt that this was released with regard to political considerations.
My guess is that the Biden Administration believes any anger will decrease by the 2022 midterms. I believe they are wrong, We shall see.

Federal courts have thus far dealt with cases that are almost all related to State laws re: COVID-19 vaccination.
This will be the first Federal order applicable a large number of Americans regarding mandatory vaccinations.
