No charges for resident who killed home invader, police say

EUGENE, Ore. -- A man who shot and killed someone who was breaking into his home will not face charges, police say.

The shooting happened at South Crest Apartments on Donald Street early Monday morning and it left Skyler Weisberg, 28, dead.

Leading up to the incident, police said Weisberg left his home in Tillamook County sometime after 10 p.m. on Sunday. Authorities pulled him over in Polk County after he made an alleged minor traffic violation, and he told the deputy he was headed to Eugene to look for his wife.

Just after 3:30 a.m., Weisberg arrived to the apartment he had lived at with his wife on Donald Street and pounded on the door, waking up the new residents of the home, a man and his girlfriend. Police said Weisberg demanded to see his wife and continued pounding on the door and window. Multiple residents at the complex called 911 to report the disturbance.

Despite the resident telling Weisberg his wife wasn’t at the location, he broke the window to get inside, police said. The resident, who was armed with a gun, kept telling the man to leave.

That’s when police said Weisberg moved toward the resident, reportedly making comments about death, and the resident shot the home invader twice. However, the man soon continued coming closer again. A third shot caused Weisberg to fall to the ground.

Police said the man and his girlfriend followed instructions from dispatch and the officers who arrived at the scene and were removed from the apartment. Medical aid was unable to revive Weisberg and he was pronounced dead.

Weisberg’s family has been contacted. Police say he had a history of mental illness and at least one prior psychotic episode.

The decision to not file criminal charges was made after consulting the Lane County District Attorney’s Office. We are withholding the name of the resident at this time as he is not facing charges in the incident.

Very true, one has to stay ahead of these animals. What he needs to do now is quickly pack up critical items and move in with a friend, while working on finding a new place to live. Once those beasts start homing in on him, his life will be hell.

Scary stuff, to live in that nightmare. But one thing that South Africa still permits is for people to take measures to defend themselves, such as the electrified fences that surround all of the nicer homes. I’m not as sure we’ll be that lucky, if the Democrats can fully implement their agenda.

He already broke through one door. Another was going to stop him???

Anyone who keeps coming after someone points a gun at him and then shoots him twice, deserves what they get.

If one door and being shot twice didn’t stop him, locking themselves in their bedroom hoping for police to arrive in time wasn’t an option.

So, a man has come to your apartment, banged on the door multiple times, broken a window, gained ingress to your apartment, and is advancing towards you while issuing multiple death threats. And rather than defending yourself with a firearm, you decide to instead retreat to the bathroom.

You (and your wife) are now locked inside a small bathroom that has only a 1x2' window (for ventilation).

For a few seconds, it's quiet.

Then you hear some liquid being splashed around outside the bathroom door. You smell gasoline. Then, suddenly, WHOOSH!

There is no escape.

How do you know that that WON'T happen?

You’re right.
The last apartment I lived in had a sturdy door, but it was built by the owner who didn’t spare the dollars. He put good doors on the place.

I’ve been looking at apartments and some do have the cheap, flimsy exterior doors. I pass those by.

What's that going to do? One kick and any flimsy bedroom or bathroom door is easily breached. Hiding in a bedroom, or any other room, most likely decreases your tactical advantage. I'd rather deal with the invader when he first enters the house.

I own apartments and most, unless the tenant puts them on, don’t have bedroom locking doors. That is not provided, nor do renters want them. We are talking about 700 sq feet of space, not much room to run and hide behind non locked doors that are hollow and can be smashed in a second.

Missing information (this and all online reports seem to derive from the same ancestor): Exact time the deceased smashed through a window, with a pumpkin no less, and entered the apartment. Exact time apartment residents made numerous 911 calls. Exact time police arrived at the apartment. Nature of Weisberg’s mental illness, prior episodes, and history of violence. Whether Weisberg was armed. How long ago Weisberg supposedly lived at the address with his “wife”.

Certainly sounds as if the time from break-in to shooting was brief, that the deceased refused to listen to reason, that the residents had good reason to fear for their lives, and that the police did not arrive instantaneously. Cheap apartment bedroom doors would hardly keep out a determined psychotic more than a few seconds, and have afforded the home invader opportunities to grab impromptu weapons. Moving backwards while an aggressor lunges at you puts you at a major disadvantage. So, no, retreat was not a viable option.

The shooter even gave the psychotic a chance to stop after the first two shots and finished him off when he persisted to advance. Sad that the guy was a nut, but the shooting was as justified as can be.

Last week....This black thug walked into our corner store and 'fired his gun' immediately into the wall....threw down the back pack for the female clerk to fill with money. Then escaped into the rear seat of a waiting SUV.

I'm still shaken by this as it happened just 5 or six blocks from my home. Never happened before so close to where I live and guns fired hardly ever.

He's still not caught but I tend to think he's from out of town. If he knew our police dept he'd never had tried this....they will hunt him down.

In a perfect world, it would have been nice if the resident did not have to kill the crazy man. I was only thinking of the resident. I did not say he should not have shot the man. I am just thinking of the personal trauma he must be going through. I CCW when I walk through town, but I would hate to have to kill someone. I am way too old to take a beating, though.

No Flames here. Taking a life is something that the apartment person will need to live with for the rest of his life. It will take an emotional toll.

In concealed carry training, I was taught that if you draw your weapon, depending on the local DA and police, you may end up in jail, no matter how justified you were in using deadly force. Basically, the judicial system does not necessarily come out with “just” results. The skill of the DA and the emotions of the jury often overturn justice.

We were taught that if you feel your life or the life of someone is in danger, then by all means, “shoot to live.” If you feel it is a life and death situation, and you choose life, then that will be a decision you must live with for the rest of your life.

My personal strategy is to back away from a deadly force confrontation if possible. If not possible, then do everything a “reasonable man” would do to avoid the use of deadly force, given the amount of time available. There may not be time to avoid deadly force.

And yes, I have a valid Oregon concealed pistol license.
