Why would being ordered to take a FDA approved vaccine be any different than the other 20+ FDA approved vaccines a soldier gets jabbed with day one of boot camp. Additionally when you deploy to the tropics Panama for example you are given additional vaccines for tropical illnesses again by lawful order. The now FDA approved Pfizer vaccine puts it legally in in exactly the same class as every other mandatory military vaccine. You don’t have to like it but it is exactly why the military waited for FDA approval to mandate it they are 100% on solid legal ground that goes back decades.
He’d need to put a few hundred thousand people on trial, right? You can’t just rubber stamp a judgment like this.
No a BCD is like a misdemeanor only a dishonorable is considered felony level. You lose your firearm rights with a dishonorable discharge question 11g on the 4473 specifically asks for dishonorable. A BCD will hamper job prospects and some states will refuse to issue you a concealed carry permit or even firearm ID card Illinois for one.
Dishonorable and BCDs require a court martial. They can not be given administratively, like say the general discharge Hunter Biden got for being crack abuser.

On one hand Biden gives a pass to Gen. Milley for clear insubordination. Milley, an unelected official, has the single duty to carry out the orders of the Commander in Chief, President Trump. Soldiers who challenge their superiors are disciplined.
On the other hand Biden wants to crush active military who do not want to obey a highly questionable order to get a vaccine.
It is questionable because it violates the constitution, of freedom to choose, my body, my choice. It is questionable because the vaccine itself is experimental at this stage.
If Biden cannot see this then might he be mildly stupid?
I know of 4 guys while at my last unit who refused the anthrax series they were put on restrictions for two months while they waited an article 15 board which then the commander decided to BCD them. I should know I was in the CID detachment who brought charges with the provost against them. BCD don’t take a full court marital panel a commander can do it with the provost.
You may wish to educate yourself on this vaccine, because it required the CDC, NIH and FDA to rewrite the definition of “vaccine” in order to be called a vaccine. They had to demonize HQZ and Ivermectin in order to get the Emergency Use Only certification. Both are proven highly effective in India, Mexico, Africa, Germany and Japan
However the COVID vaccine has killed over 15.000 in the US so far ( see VAERS) with reports as high as 150,000 dead. This doesn’t include those with permanent heart issues, strokes or long term studies. Some say most vaccination victims will die in 3-5 years.
