Prosecutors Lost A Fight To Keep A Set Of Jan. 6 Capitol Surveillance Videos Under Seal

Federal prosecutors on Tuesday released a new collection of Capitol surveillance videos from Jan. 6 after a judge ordered them to do so, rejecting the government’s argument that making the clips public could threaten the security of the complex.

The disclosure marks a setback for the US Capitol Police and the US attorney’s office in their efforts to control how much footage from the Capitol’s closed-circuit video (CCV) system gets out. In the latest case, prosecutors argued that revealing the location and vantage points of more cameras could help “bad actors” trying to plan some future assault on the building. A judge concluded that argument was too speculative, however, and that the public had a strong interest in seeing videos that formed the basis for a recent plea deal.

US District Chief Judge Beryl Howell ordered the videos released in response to a request from a media coalition (including BuzzFeed News) that is petitioning judges on a rolling basis for videos that prosecutors have relied on in Jan. 6 cases. Howell’s decision isn’t binding on other judges in the US District Court for the District of Columbia presiding over Capitol riot prosecutions, but it gives the media coalition a favorable ruling to point to in future fights.

The clips cover a period of about 15 minutes on Jan. 6 — between 2:25 p.m. and 2:40 p.m. — in different locations inside the Capitol. They show rioters streaming through open doors and broken windows at an entrance on the Senate side; crowds of people walking into the Crypt, standing in a large crowd, and eventually dispersing; and, finally, rioters exiting as US Capitol Police officers in riot gear gather at the Senate entrance point to stand guard as a mob that’s outside looks in through the broken windows.

and how is this not prosecutorial misconduct? To exclude potentially exculpatory evidence from a defendant should disbar the prosecutor

I suppose they will argue that it was “for national security” which in the past, has allowed them to hide and redact EVERYTHING.

I remember a short while back, a FOIA request resulted in the release of important documents in which entire pages were simply covered top to bottom in redactions.

Nancy Pelosi is trying to keep secret videos that show people in areas where public tours are conducted. The article says the people “stormed the Capitol.” In actuality, they just walked in. I wonder how many of the instigators are actually Trump supporters. Most of the people were just useful idiots who messed up their own lives and ruined much for the make America great again movement.

Prosecutorial misconduct is a joke. I was involved in a criminal case being prosecuted by the State Attorneys Generals Office (yeah, I’m a real bad ass, sarc). The county Assistant District Attorney (my estranged daughter) was colluding with the Attorneys General’s office on multiple occasions. The Judge was aware of this and only reprimanded the Prosecutor. This had no bearing on the case because the damage was done. If I was ever inclined, I could destroy the Assistant District Attorneys career. I have so much video and tweets of her talking about being evil on court, making fun of other attorneys and defendants. I’d love to know how many innocent lives shes ruined so far. These people appear to be “just”, but they are a joke.

Notice BuzzHeads use of the term “Rioters” - not protestors, concerned citizens or other less damning terms.

Also, the vantage point of the cameras being sacrosanct has got to be the lamest reasoning to keep the video unreleased; being the US Senate and House they would have zero qualms about spending millions to relocate and/or double, even triple, the number of surveillance cameras. Just none where they can be seen sexually harassing their aides.

Each and every media 'hole who refers to the January 6th protest as an "insurrection" should be prosecuted under the RICO Act.

Some people need to remember the lessons that apparently nobody leaned from the Gen. Flynn fiasco. When you plead guilty to a crime you waive your right to any exculpatory evidence.

The prosecutors weren’t trying to withhold this information from the defendants. They wanted to hide it from the MEDIA.

I would say all of it should be released to the jury but 14,000 hours? Dayum. That’s 1750 days of watching at 8 hours a day.

The problem with releasing some footage concerns the questions that’ll raised about the other unreleased footage. That “other” footage would cause quite the stir.

How do we know which people were innocent Trump supporters and which ones were plants/agitators? The second/third video shows folks gleefully dancing in the rotunda. Doubtful they were innocent folks. What about the folks with backpacks, or flags?

I will add to that it's not like these are hidden cameras, anyone looking up can see them, just like Walmart.
