Turley says Ron Klain's vaccine retweet is legal issue for Biden: 'Breathtakingly daft'
Fox News ^ | September 10, 2021 | Emma Colton

Posted on 09/10/2021 10:29:31 AM PDT by jazusamo

Constitutional scholar Jonathan Turley called White House chief of staff Ron Klain’s recent retweet appearing to praise the Biden administration for executing the "ultimate work-around" for President Biden’s recent vaccine mandate "breathtakingly daft."

"The retweet was breathtakingly daft on the eve of litigation over the order. It is reminiscent of President Biden admitting that his own White House counsel and their preferred legal experts all said that the eviction moratorium extension was likely unconstitutional," Turley told Fox News on Friday.

"Courts will now be asked to ignore the admission and uphold a self-admitted evasion of constitutional limits," Turley added. The "problem is that the thing being ‘worked around’ is the Constitution."

Turley’s comment came in response to Klain retweeting MSNBC’s Stephanie Ruhle on Thursday, who tweeted: "OSHA doing this vaxx mandate as an emergency workplace safety rule is the ultimate work-around for the Federal govt to require vaccinations."

"Klain effectively became a witness for the challengers in labeling the order an evasion or subterfuge designed for the courts. Klain leaves the courts in the unenviable position of ratifying an order that the Administration admits is a mere work around to evade constitutional limits. It is akin to claiming self-defense in an assault case while saying that it was the best way to shoot the guy," Turley said.

Klain’s retweet came after President Biden announced a sweeping mandate requiring private employers with more than 100 employees to be vaccinated or submit to weekly testing. The mandate affects about 80 million Americans.

More and more, I think we see this administration making an effort to rub our noses in it. They do the wrong thing. They say the wrong thing. They explain to us that they are saying the wrong thing because it helps them to do the wrong thing. It’s completely “in your face”.

Personally, I think they want to start a civil war. And that, for two reasons — 1) They could impose martial law and get even more power and 2) Whether the Bad Guys win or lose the war, they will destroy the country, ruin our ideals, and remove China’s only real opponent. Sure, the Bad Guys want to win. But they don’t even have to. Simply causing the war would be sufficient victory.

The problem, as I see it, is the left has caused spikes in anxiety across the hearts and minds of 80m Americans. I’m 5 years sober and have never been so dangerously close to falling off the wagon as I am right now. My employer WILL fire me for not being vaccinated. I have zero doubt about that. The problem is that if every other organization out there abides, I’ll never be employed again. Everything about my life will slide off. That’s depressing as hell.

Many here assume that our deep state political and military leaders, while evil, are high IQ, intelligent and far-sighted in their plans and conspiracies - the ultimate 4D chess players.

Hanlon’s razor says: “Never attribute to malice that which is adequately explained by stupidity.” I would add laziness, ego, and greed to that list.

I do think Klain made a mistake. Although his mistake was so obvious, a conspiracist might theorize that it was intentional sabotage disguised as praise.

Nowadays the Deep State, and world at large, is in such chaos that it's impossible to know who's in charge, and whether anything is real, or disinformation, or incompetence, or sabotage.

Does this guy really think the commie dems are still worried about legal issues?

I'm sorry but we've been looking to the commie controlled courts for answers for far too long. The courts are NOT going to save this country, in fact they are working to destroy it.

Quit suing and start doing. Start causing serious pain to the left. Organize massive walkouts of any company including hospitals that attempt vaccine mandates. Put a few of these companies out of business and they will change their ways.

OSHA is legally restricted about what kind of rules it can make, and more importantly, the process it must follow to promulgate those rules. This announcement was meant to give Biden breathing room from Afghanistan and the Economy. It follows there rule of “Do Until the Courts Undo”(DICU) Lawfare philosophy.

Not sure what line of work you’re in, but moving to a small business has many advantages over large corporations.

OSHA rules are a smokescreen. OSHA is legally restricted about what kind of rules it can make, and more importantly, the process it must follow to promulgate those rules, which takes lots of time. This announcement was meant to give Biden breathing room from Afghanistan and the Economy. It follows their rule of “Do Until the Courts Undo”(DICU) Lawfare philosophy.

Most jobs in America are in small business. Those employers are desperate for people and are exempt from the vaxx mandate. I would be out looking around now. You might even end up in a better position.

I think there was a simpler reason for the announcement:

1. Effectively giving major U.S. corporations immunity from civil lawsuits in the event they mandate vaccines for their staff and then a vaccinated employee has terrible side effects from the vaccine.

2. Attempting to put an end to this idiocy where we have millions of job openings across the nation and millions of able-bodied people who refuse to go back to work because they've bought into all the media hype and Branch Covidian fear-mongering over the last 18 months.

This is why Communist nations have such large black markets. Increasing regulation drives ever more producers and consumers underground.

During the closing years of the Cold War, the Soviet black market's GDP was several times that of its legal market's GDP.

“Courts will now be asked to ignore the admission and uphold a self-admitted evasion of constitutional limits.”

Guess what professor. Judges do that kind of thing all the time.
