In this particular case, it is very clear that there was a conspiracy. Go watch this video. Ms. Babbitt was standing with two armed policemen who didn't seem to be upset with her.
Given the behavior of the man who provoked the people to smash the windows, who later went to change his clothes, I assume that the event was preplanned.

Even after listening to him, I feel he should be charged and tried for murder. He killed an unarmed woman who was not threatening to him or anyone. If he was tried and found not guilty, then fine. But he should be tried.
