Clickbait fake news. The actual executive order says:

Telephone assessments for involuntary commitment cases are permitted. The provisions of Tennessee Code Annotated, Section 33-4-108, are hereby suspended to the extent necessary to allow the issuance of a certificate of need under Tennessee Code Annotated, Section 33-6-404, for the emergency involuntary commitment of a person with a mental illness or serious emotional disturbance based upon a telephone assessment of such person by a mandatory pre-screening agent designated pursuant to Tennessee Code Annotated, Sections 33-6-104 and 33-6- 427, if the following conditions are met:

(In other words, a psychiatrist can evaluature a mental patient via teleconferencing. This is not an authorization to involuntarily hold anti-vaxers.)

I don’t know what defines a “mandatory pre-screening agent” who determines whether a person is in need of immediate commitment without consent under Tennessee statute. What I do know the order does not change that criteria but only changes it so it may be done by phone with certain limitations. That’s it.

Remember those who are presented for such pre-screening are usually brought to the attention of the agent by either a doctor treating the person, family members, or law enforcement. Basically this happens when the person is considered a threat to themselves or others. In most state such commitment is limited to 72 hours and then further action may or may not be taken by the doctor in charge of that person’s care while they are an inpatient. Oh and the patient does have rights including to representation.
