So? IIRC, there is a federal preemption law protects folks who are travelling with firearm from unconstitutional restrictions.

That law only applies when you are traveling from a place where the firearms are legal, to a place where the firearms are legal. He traveled to a place where the firearms were not legal, and was not stopped in a vehicle.

I still would not chance it. It is a whole different world up there. Normal law is turned on it’s head.

I carry a handgun travelling from Colorado to Illinois when I go back to visit relatives. While there I leave it in my luggage and don’t strap it on again until I cross the border leaving the state.

I would never attempt to travel through NY, NJ, CT, or RI relying only on the Firearm Owners Protection Act. The FOPA is an affirmative defense, which means those states will arrest you, they will confiscate your firearms, and they will send you to trial, at which point you can assert the FOPA to have the charges dismissed.

The FOPA states:

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

None of this applied to the firearms found in a hotel room.

Why would someone who visited Chicago anyway, leave a loaded rifle in a hotel room, in clear view, by a window?

The article only says the handgun was loaded, not the rifle. As to the placement, the room is mostly window. There's not a lot of other places to keep it...

In Portland, OR it is against the law to have a loaded firearm without a permit.

BTW - the pistol under in one location and the magazine with rounds in it in another location is still considered “loaded”. The magazine needs to be empty!

Not exactly. No FOID needed for mere possession by non residents if they are legal possessors in their home state. If by some odd chance of personal misfortune you are moving there you are required to get one. Transporting rules for non-res remain...unloaded in a case.

I have to wonder what kind of case he carried the rifle in while walking through the lobby and riding the elevator. I think I’d have left it in that, under the bed.
