Alan Dershowitz Predicts Charges Against Trump Organization’s CFO Will Be Tossed

Harvard Law professor emeritus Alan Dershowitz says he believes federal tax fraud charges filed in New York City against The Trump Organization’s longtime finance chief will end up being dismissed.

“You can’t get a city district attorney indicting somebody for failing to pay federal income taxes when the IRS hasn’t even gone after him,” Dershowitz said in a July 3 interview with Newsmax. “One of the charges, a major charge, is grand larceny against the United States government.

“That shows the extent to which they are prepared to stretch existing law and the Constitution to give them authority over federal taxes. It’s absurd.”

On July 1, The Trump Organization and its chief financial officer, Allen Weisselberg, were charged in what New York prosecutors called a “sweeping and audacious” tax fraud scheme in which Trump’s company and Weisselberg allegedly cheated the state and city out of taxes by conspiring to pay senior executives off the books by way of fringe benefits, such as apartment rent and car payments.

Prosecutor Carey Dunne said in court that the alleged scheme was “orchestrated by the most senior executives” at the firm and got “secret pay raises at the expense of state and federal taxpayers.”

Weisselberg and attorneys for The Trump Organization have pleaded not guilty.

Ahead of the unsealing of the criminal indictment on July 1, The Trump Organization criticized Manhattan prosecutors for what they claimed was a partisan criminal investigation designed to hurt Trump politically. In a July 1 statement, The Trump Organization said the probe “is not justice; this is politics.”

Dunne pushed back on the claim, saying that “politics has no role in the jury chamber, and I can assure you it had no role here.”

Alan Futerfas, a member of The Trump Organization’s defense team, disagreed.

As in he CAN assure us, but he didn’t, and he won’t.

Look at the Judges that Flynn. Stone, Papadopolous, and Manafort drew.

They were out for blood from the outset.

Amy Berman Jackson made statements about one or more of the defendants (rightly) dying in prison before one piece of evidence was submitted.

It’s way too late for peeps to be underestimating the Hate for Trump and his supporters. It’s more like - what won’t they do.

They were merely fishing for information that they could use against Mr. Trump in the future at their convenience. It will be some kind of justification for an investigation on a charge they've not yet invented.

How far America has fallen! It's considered a crime to try and keep more of your own money! While they preach endlessly about slavery they strive to make all of into free range slaves!

You can get them for not paying state taxes.

They were trying to get the guy to flip on Trump and he wouldn’t do it. There’s nothing to flip on. Trump isn’t a crook. Now the prosecutors are stuck with this debacle.

Yep, that was the original idea and strategy... get an underling on a small, trumped up charge, then, do a plea bargain deal to give him a small sentence in exchange for possible dirt on Trump.

The Democrat prosecutors did the same things on the Russia Collusion Hoax, we should know their modus operandi by now.

In New York, the state taxable income is predicated on the federal reported income. If the amount was ok with the feds, the state can’t jack it up, after the fact, under the existing laws at that time.

So if someone is underreporting income to the Federal government then they are underreporting income to the state, and avoiding state taxes as well. Hence the state charges.
