Man accused of shooting and killing Austin protester indicted on felony murder, aggravated assault charges

AUSTIN (KXAN) — A man who previously said he shot and killed a protester out of self defense in downtown Austin in July 2020 has been indicted on felony charges of murder and aggravated assault with a deadly weapon and a misdemeanor charge of deadly conduct, according to a statement from his lawyer.

The lawyer says Daniel Perry posted a $300,000 bond and has been released from custody.

Perry “will vigorously fight all of these charges,” the lawyer says. Police identified the man killed in the July 25, 2020 shooting as Garrett Foster.

Austin Police identifies man killed in shooting during downtown protest Saturday According to APD’s description of the incident, a car turned on Congress Avenue near 4th Street at 9:51 p.m. into where a group of protesters was marching against police violence. Protesters surrounded the car. Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.

Former Austin Police Chief Brian Manley said that’s when the driver fired five shots from inside the vehicle, hitting Foster multiple times. Foster never fired a shot. Another protester then shot at the car three times but did not hit anyone.

The court case will likely hinge on whether the evidence shows the person killed was demonstrating ""Deadly Conduct" or "Disorderly Conduct" as defined by Texas's penal code.

Proving the killed person was showing 'deadly conduct' should acquit the one being charged while proving 'disorderly conduct' will probably bring him a felony conviction.

Re: Texas penal codes: 22.05 Deadly Conduct & 42.01 Disorderly Conduct.

I believe the prosecution will try to prove that the one killed was "acting disorderly", which probably does not justify him being shot and killed. The defense will try to prove that the person killed was displaying "deadly conduct", which should acquit the person being charged.

People really don't understand basic firearm safety rules.

One of the primary rules is you never point a firearm at anything you don't intend to shoot/destroy.

That means if you point a firearm at me, you mean to shoot and kill me. As such, I should fear for my life and have a right to defend myself with deadly force, as my life is in immanent danger.

If the jury is educated on firearm safety the verdict should be rendered in just a couple minutes of deliberation.

If a gun is pointed at a person a reasonable person can act in self-defense if he believes he is faced with possible death or great bodily harm.

Sounds like a speculative contention to me. We don’t even know if there was a round chambered in the rifle, do we?

If a car is a threat to people, would it not be reasonable for someone to raise a firearm in defense of those lives, just as it is reasonable for the driver to defend himself from said raised firearm? The space in between those two scenarios is where the prosecution and defense will battle it out.

Many of the posts on this thread indicate that people need to adjust their thinking to fit the new tyrannical paradigm.

I hope that I haven’t unduly strained your vocabulary or ability to comprehend written English.

From the way I read the details, the shooter in question had made a wrong turn of sorts and stopped. His car then became surrounded by protesters, including the BLM fool with a knock-off AK. When said knock-off AK was raised to a high-ready position is when the individual in the car assessed a life-threatening situation and took action.
