Man accused of shooting and killing Austin protester indicted on felony murder, aggravated assault charges

AUSTIN (KXAN) — A man who previously said he shot and killed a protester out of self defense in downtown Austin in July 2020 has been indicted on felony charges of murder and aggravated assault with a deadly weapon and a misdemeanor charge of deadly conduct, according to a statement from his lawyer.

The lawyer says Daniel Perry posted a $300,000 bond and has been released from custody.

Perry “will vigorously fight all of these charges,” the lawyer says. Police identified the man killed in the July 25, 2020 shooting as Garrett Foster.

Austin Police identifies man killed in shooting during downtown protest Saturday According to APD’s description of the incident, a car turned on Congress Avenue near 4th Street at 9:51 p.m. into where a group of protesters was marching against police violence. Protesters surrounded the car. Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.

Former Austin Police Chief Brian Manley said that’s when the driver fired five shots from inside the vehicle, hitting Foster multiple times. Foster never fired a shot. Another protester then shot at the car three times but did not hit anyone.

Really? GFM is a liberal hate site that does not support conservatism.

I’m surprised they have not canceled this fundraiser. Now that charges have been filed, I’m betting they will ghost this ASAP.

And the guy that got shot was posting on-line he was going out armed and be the Protector of the BLM, and he didn’t care what happened to him, personally.

The prosecution will claim that the deceased was defending protesters that were about to be run over.

presenting at high ready (if that’s what he did) is considered ‘aggravated assault with a deadly weapon’ in the state of Texas I believe.... seems to meet the threshold of using force to mitigate the threat

Had his hand on the pistol grip and other hand on the forearm of the weapon. Appears the stock is on his shoulder. That’s a position of high threat. He got what he deserved.

Foster was armed with an assault-style weapon and was one of the protesters who surrounded the car.(and pointed his weapon at the driver who felt threatened and protected himself.)

Imagine an attorney pointing a weapon at the jury and asking if the feel threatened! Even if just imagined it would have great impact.

Again, prosecution will argue that he was defending protesters in danger of being run over by Sgt. Perry, and was defending them. It’s plenty of wiggle room for a Soros DA to work with. Look at the McCloskys in St. Louis.
