Kendi appeared in a Politico Magazine video in which he said:
To fix the original sin of racism, Americans should pass an anti-racist amendment to the U.S. Constitution that enshrines two guiding anti-racist principals: Racial inequity is evidence of racist policy and the different racial groups are equals. The amendment would make unconstitutional racial inequity over a certain threshold, as well as racist ideas by public officials (with “racist ideas” and “public official” clearly defined).
It would establish and permanently fund the Department of Anti-racism (DOA) comprised of formally trained experts on racism and no political appointees. The DOA would be responsible for pre-clearing all local, state and federal public policies to ensure they won’t yield racial inequity, monitor those policies, investigate private racist policies when racial inequity surfaces, and monitor public officials for expressions of racist ideas.
The DOA would be empowered with disciplinary tools to wield over and against policymakers and public officials who do not voluntarily change their racist policy and ideas.

They are trying to create a recognized power structure outside of the legtimate power structures, to control the legitimate power structures.
These people can’t govern, they can’t win office, they can’t get into the power structure the normal way, plus they do illegal things which would get them fined or jailed or both, so they want to force new positions to be filled by them, and demand they receive real authority and salaries.
From these positions they will demand more powerand demand the removal of elected and admin people in govt that do not go along with them.

We have a USSC which hears cases over policies and laws as they may fail to protect equal rights. The remedy is such. That and electing legislators who write bad laws along with unelected bureaucrats who regulate our society with bad policies.

The point is, groups do have significant differences. An exact equality of outcomes is not to be expected.
The problem, however, is that any discussion of group differences as anything other than a "problem" to be solved has become taboo in academia, the media, and the political realm. The assertion of group sameness has become dogma. It can be career ending to challenge it openly. And it is simply false. Murray calls this "The Orthodoxy." From the introduction:

The core doctrine of the orthodoxy in the social sciences is a particular understanding of human equality. I don’t mean equality in the sense of America’s traditional ideal – all are equal in the eyes of God, have equal inherent dignity, and should be treated equally under the law – but equality in the sense of sameness. Call it the sameness principle: In a properly run society, people of all human groupings will have similar life outcomes. Individuals might have differences in abilities, the orthodoxy (usually) acknowledges, except for undeniable ones such as height, upper body strength, and skin color. Inside the cranium, all groups are the same.
The sameness principle theoretically applies to any method of grouping people, but three of them have dominated the discussion for a long time: gender, race, and socioeconomic class. Rephrased in terms of those groups, the sameness premise holds that whatever their gender, race, or the class they are born into, people in every group should become electrical engineers, nurture toddlers, win chess tournaments, and write sci-fi novels in roughly equal proportions. The assertion that all group differences are the result of racist or sexist policy and culture is simply false. It is a lie. This is not to deny that public policy is irrelevant; bad policy does indeed have bad outcomes, and that is something we should always be alert to address. But we must avoid the reductionist fallacy. The lie is currently being weaponized as a single factor, reductionist explanation of every social difference. This has totalitarian implications because the lie insists on something that will virtually never emerge from spontaneous, natural, social self-organization.
This is precisely why the left has seized with such ferocity on critical race theory and the current gender insanity. The lie creates a standard that will never be met in a free society, because the lie rests on a false model of human nature. If the lie is allowed to drive policy, the result will be comprehensive government control, increasingly totalitarian in reach because every failure to achieve exact sameness will be met by a doubling down on the lie with ever increasing intensity. The left has always hated the concept and operation of a free society. Critical race theory and the gender identitarians have given the left a weapon that is designed to smash every expression of spontaneous free social organization.
