SCOTUS Strikes Down Biden-Backed Police Firearm Seizure Case

The Supreme Court has dealt the Biden administration a defeat on a “caretaking” case. The case tested whether or not police could enter private property without a warrant if an individual was believed to pose a threat to himself or others.

In the case Caniglia v. Strom, the Supreme Court ruled that “caretaking” did not justify entering a man’s home to remove firearms because he was believed to have expressed suicidal thoughts. The man was taken to a local mental health facility for psychiatric evaluation.

“Police entered the home under a ‘community caretaking’ exception that allows entry in cases where doing so benefits the public interest, which has traditionally applied to incidents regarding vehicles but not in homes,” Forbes reported.

"My sense is they traded off on another controversial area that we’ll find out about later."

Probably they'll uphold SCOTUS usurped Privilege of creating a Constitutional amendment by finding a penumbra of law in Roe vs. Wade keeping murder of the most innocent legal.

You would be very hard-pressed to find (and present to the Supreme Court) a more direct violation of the 4th Amendment. If they didn’t rule this way, they might as well have said that the 4th Amendment is unconstitutional.

‘Mental Illness’ was the old Soviet Union excuse for arrests and other things....................

Well, it was pretty logical - if you opposed the Soviet system from within the system, knowing of the power of the NKVD/KGB, you HAD to be mentally ill. Or so they said.

“ They must have traded off on a different case.”

Must be, three new puppets would never have voted to keep our rights. Not after they did away with them in the election case.

Cute but worthless advise.

Hope is important when things are not going your way, otherwise why keep trying. Sorry to think you are the type that when things get rough just give up.

(If not, what motivates you to keep trying if things are “hopeless”)

Knowing this gun case was coming out, they could have used the election fraud cases as the tradeoff.

I didn’t think of that. They should get quite a few trade offs for allowing election fraud.

"Police will follow orders."

Not all Sheriffs, as we've seen by many recent statements. Remember, Sheriffs hold more power than local city police.

Thanks for posting that. GOA deserves the credit for backing this court filing.

I donate to them when possible.
