Fourth Circuit Overturns Conviction Of Retired Air Force Colonel For Using Racial Slur

In a major but likely controversial victory for free speech, the United States Court of Appeals for the Fourth Circuit overturned the conviction of a retired Air Force colonel for using a racial epithet at the shoe store on the Marine base at Quantico, Virginia. Jules A. Bartow, who is white, was arrested after a bizarre and disgraceful exchange with an employee, including the use of the “n word” with the African American woman. The highly offensive and repugnant language of Bartow was denounced by the court, but the unanimous panel still reversed T.S. Ellis III, Senior District Judge of the Eastern District of Virginia on First Amendment grounds.

Free speech advocates must often defend those who are despised or language that is deeply offensive. The First Amendment is not designed to protect popular speech or popular people. Such speech and such people rarely need protection. That means that we must resist attacks on free speech in cases where we find speech to be repugnant and repulsive. That is the case with retired Air Force Lieutenant Colonel Jules A. Bartow.

exactly- the SC has upheld the right of that vile ‘church ‘( Westboro baptist I think it is?) to go to soldier’s funerals and scream through bull horns that God killed the soldier for supporting homosexuality in the army or some such thing- right in front of the people there mourning the loss of their loved ones-

Especially since the majority of blacks (not all, but most), use that same expression with each other. Double standards suck. I'm a white female. I don't use that term, and when I worked in Corrections, and black inmates would call each other that in my presence, I'd tell them not to say it in front of me. I can remember when the standard and accepted term for blacks, was "colored." Then in the late 60's and early 70's, the accepted term was African-American. I said "colored person" one time to a young college student who was interning at the Dept. of Social Services where I was working back then, and she snidely said "Oh, what color were they?" The accepted terms for blacks have changed repeatedly over the years: Colored, African-American, black, person of color, etc. I wish they'd find one, and stick with it.

IF one needs to use language that might offend ... One might ought to check out music videos wherein said language is put to beats ... Sing a song .. I just sitting at a stop light have heard all manner of ‘words’ thumping out of the vehicle beside me.

What’s worse is that he was also THINKING of the N word. (see we can’t even bring ourselves to say it )

Thinking it is a hate crime. Like when you kill someone
(it should be a lesser of a crime if you kill someone while loving them) and there is no constitutional protection for your thoughts. Even now we are being patrolled by the thought police.

We had one and used it for years. They did not like it.

How stupid is it for people to get so hung up on words. words are just word to describe something. How is it that if the N word is bad but black is good, but they both describe the same thing.

In my experience, too many black people in service positions are filled with resentment for having to work.

Some are filled with animosity towards white people, who they have been taught to hate.

This appears to be more common of black women than black men.

They do not provide the usual pleasant interchange with customers that is required in service jobs.

They will needlessly annoy people and provoke them.

I’m sure some of them have never been taught good manners — but that is no excuse.

It is still required in dealing with the public.

It makes everything more pleasant for both parties to a conversation and transaction.

For the customer, a nasty service encounter violates all the rules of civilization.

People are supposed to try to be nice, even more so in a commercial setting.

In the current Black Lives Matter anti-white hysteria being propagated by the Left and the media, expect more of this.

Ruling makes commons sense under the former Constitution...

Here in MD, you cannot escape the verbal expressions by one segment of our society (between the ages of 3-to-100) using the n-word and m-f-words in almost every single utterance...

If one reads the former Constitution, which the 4th Circuit must have, we the people do not have to be niggardly with the choice of words in our speech...
