The Labor Department under the Biden administration blocked a Trump-era rule Wednesday that would’ve made it easier for companies to classify workers as independent contractors instead of employees under federal law.
The move comes one week after Labor Secretary Marty Walsh told Reuters that many gig workers should be classified as “employees” who deserve company benefits. His boss, President Biden, is a big supporter of labor unions.
Gig workers are independent contractors who perform on-demand services, such as childcare providers and drivers working for companies like Uber and DoorDash.
The rule under the Trump administration would have made it harder for workers to earn a minimum wage and get paid overtime.
That rule was supposed to take effect last month but did not because the Biden Administration was reviewing it. The withdrawal takes effect Thursday.
On Wall Street Wednesday, shares of Uber, Lyft and DoorDash fell more than 2% in early trading.

No, this is good to help these ‘gig workers’ get regular pay, overtime when due, and potentially benefits. I’ve worked as an IT consultant, a contractor, and now, I guess, as a ‘gig worker’ since the mid-80s. A few protections for the younger folks that know no better would be helpful since these roles have become the norm whereas in the early 80s they were fringe oddities.
When I was a 1099, I was able to avoid almost all payroll taxes and put that money into my own IRA. Fully deductible “Business expenses” completely avoided income tax.
In or out of power, the Democrats are in a state of total economic war against the (non-politically-connected) people.
The sooner this economy bursts into flames the happier I’ll be. Without extreme pain, radical change will not happen.

Federal court rules California’s gig economy law applies to another group of workers
Apr. 28—A new California law directing employers to provide benefits to more workers applies to truck drivers, a federal court ruled Wednesday as it overturned a previous decision that had allowed them to operate as independent contractors.
The ruling by the Ninth Circuit Court of Appeals could apply to as many as 70,000 truck drivers in California who continued to work classified as independent contractors after Gov. Gavin Newsom signed the gig economy law known as Assembly Bill 5 in 2019.
“Today’s ruling from the 9th Circuit is a massive victory for California’s truck drivers, who for far too long have faced exploitation and misclassification at the hands of trucking companies that place corporate profit ahead of drivers’ safety and well-being,” the labor union International Brotherhood of Teamsters, which represents some truck drivers, said in a statement.
The California Trucking Association sought to fight AB 5 in court, suing California in 2019. The association had said AB 5 threatens the livelihood of independent truckers, some of whom invested hundreds of thousands of dollars in buying clean trucks and enjoyed the right to set their own schedule.
In a statement Wednesday, the association’s CEO, Shawn Yadon, vowed to appeal the new decision.
“The California Trucking Association will take any and all legal steps necessary to continue this fight on behalf of independent owner-operators and motor operators operating in California,” Yadon said.

With respect, there are all sorts of “gig workers.” Let’s not conflate the part-timer, side-timer, entrepreneur, innovator, with OTR CDL drivers, IT contractors with unique skills, and the poor schlumpf trying to stay afloat after being laid off from his old job, by driving for Uber.
One-Size-Fits-All never out-performs the rationing of free enterprise and free personal choice.
But it’s easier to play on what passes for the press these days and on the stupidwebs.
