The Tennessee House voted Monday evening to make the state a Second Amendment sanctuary.
The House adopted Senate Bill 1335, which passed last week in the Senate. It “affirms that any law, treaty, executive order, rule, or regulation of the United States government” that violates the Second Amendment is unenforceable.
That violation would have to be determined by either the Tennessee or U.S. Supreme Court. Any official that would then attempt to enforce the unconstitutional law would then be subject to ouster.
The bill now will head to Gov. Bill Lee’s desk.
Second amendment banglist.
Is this simply barring state and local law enforcement from cooperating with Federal officials on enforcement of unconstitutional Federal gun laws? Or is this doing something more?
It states that any law ruled unconstitutional by the state supreme court will be unenforceable.
But just by state and local law enforcement? Or is it telling state and local law enforcement they have to actively prevent Federal law enforcement from enforcing such laws?
Exactly — I want to know how this affects fully automatic weapons, short-barreled rifles, suppressors, and other such things. If anything goes in TN, then you have something really good, in my opinion.
Hope Florida does the same type of thing.
Add one more check mark to the “Pro” side of the list.
Personally I like hand grenades of the fragmentary type.
For example you can end a demonstration turned violent or destructive really quick with just one of them.
Just my opinion.
Third paragraph.
The state Supreme Court will have to rule on a federal law first.
Couldn’t find it in that article, but a linked article had more details:
“The measure also “prohibits the state and political subdivisions from using public resources to enforce, administer, or cooperate with the enforcement or administration of any such treaty, executive order, rule, or regulation.”” - https://tennesseeconservativenews.com/measure-making-tennessee-a-second-amendment-sanctuary-state-passes-senate/
I would think this stuff would be tailor-made for US Supreme Court review.
The Bill of Rights restricts the government.
It does not restrict individuals.
The Second Amendment states that the Right shall not be infringed So government at any level ought to do no infringing. Not allowed. Shall not.
If a State like TN decides to ignore all infringements as inherently unconstitutional, would the Supreme Court really disagree? I know they would want to, but it just defies logic when you ask the question the right way.
This Ping List is for all things pertaining to infringes upon or victories for the 2nd Amendment.
FReepmail me if you want to be added to or deleted from the list.

First of all, good on Tennessee! Marysville was on my Short List of retirement spots, had I not gotten a better offer. ;)
Secondly, WHY is it so HARD for Socialist Democrats (or ANYONE) to understand that the entire CONCEPT of our Constitution, as ORIGINALLY WRITTEN, is to PROTECT, ‘We The People’ FROM Mother Government and her overreach? Our Forefathers LIVED through the TYRANNY of a Monarchy, fer Pete’s Sake! It’s not like they didn’t know what they were talking about, or WHAT to protect us from when it came to tyrants!
Yeesh! Yeah, I know; Preachin’ to the Choir! ;)
You trust our State Supreme Court? After we had to bounce Penny White for being Anti Death Penalty, and nearly got Adolpho Birch, till he screamed racism? The Black on black murder rate just keeps climbing in BLUE run Memphis. If they hate the Death Penalty they hate Guns too.
While I fully support this step in the right direction for the state of TN, it still begs the immediate question. Why wait for the TN supreme court to weigh in? This still leaves the door open for any otherwise law abiding TN resident to be terrorized by the ATF or FBI until the TN supreme court steps in.
Why not just straight up nullify all federal gun laws including the NFA and GCA and make attempts at enforcement by any entity local, state or federal a crime?
Why not just close the door on gun control for good in the state?
Once just one state does this and sets the example several other states will follow and the people will see there is no reason to fear freedom.
TN is so close but still not quite there.
Yeah baby...push it on through...
2A bump for later....
FFL dealers would be in a bind because of the much abused interstate commerce clause. Would manufacturers ship to Tennessee?
