A group of white Midwestern farmers has filed a lawsuit against the Biden administration for racial discrimination over being banned from a loan forgiveness program offered only to farmers of color, due to the fact that they are ineligible "solely due to their race."
The Wisconsin Institute for Law & Liberty is representing the plaintiffs from Wisconsin, Minnesota, South Dakota and Ohio in their suit against U.S. Secretary of Agriculture Thomas Vilsack and Farm Service Agency administrator Zach Ducheneaux.
Their complaint argues that a loan program as part of the American Rescue Plan Act of 2021 for "socially disadvantaged" farmers is unconstitutional because it is race-based.
The Milwaukee Journal Sentinel noted that the program "pays up to 120% of direct or guaranteed farm loan balances for producers who are Black, American Indian or Alaskan native, Hispanic or Latino, and Asian American or Pacific Islander." But white producers do not qualify.
"Were plaintiffs eligible for the loan forgiveness benefit, they would have the opportunity to make additional investments in their property, expand their farms, purchase equipment and supplies, and otherwise support their families and local communities," the lawsuit reads. "Because plaintiffs are ineligible to even apply for the program solely due to their race, they have been denied the equal protection of the law and therefore suffered harm."
One of the plaintiffs in the suit is Adam Faust, a dairy farmer and double amputee. He told the Journal Sentinel, "There should absolutely be no federal dollars going anywhere just based on race. The economic impact from COVID-19 didn't hurt any race more than another as far as agriculture goes."

It’s a slam dunk civil rights violation, but I doubt the courts will remedy it.

The Court takes the Law School at its word that it would like nothing better than to find a race-neutral admissions formula and will terminate its use of racial preferences as soon as practicable. The Court expects that 25 years from now, the use of racial preferences will no longer be necessary to further the interest approved today.
The law is dead. Lawsuits are not reality. We have a fake, illegal government. A useless Supreme Court is not going to hear this.

FSA Began Accepting CFAP 2 Applications on April 5th
The U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) announces the availability of $2 million to establish partnerships with organizations to provide outreach and technical assistance to socially disadvantaged farmers and ranchers. The funding was made possible by USDA’s new Pandemic Assistance for Producers initiative, an effort to distribute resources more broadly and to put greater emphasis on outreach to small and socially disadvantaged producers impacted by the pandemic.

Awards will range from $20,000 to $99,999 for a duration between six months and one year. Applications focusing primarily on CFAP 2 will be expedited. For other proposals, FSA anticipates announcing or notifying successful and unsuccessful applicants by June 20, 2021 and expects to have Federal awards in place by September 1, 2021.

Nationwide, at least in 2017...there were 45,500 black farmers in the US. One key thing...this adds up to a max of around 13-percent (NPR numbers), but in terms of ownership of farm/ranch land, they own around 1-percent. It’s a misleading number though.
If you think about ranch ownership (like in Colorado, Montana, or Utah), a massive amount of that is operated by white ranch-owners.
The problem with this discussion....since the 1920s...farms and ranches have lessen in terms of ownership almost every decade (doesn’t matter if you talk black, white or Latino)....so massive operations now exist because it’s just not an attractive work and business operation, and built with serious risks.
Biden administration creates Green Acres farms for white folks in hopes to get votes from racist liberals.
Dems would be smart to fix the program and remove the race-based element, because it is likely that given the opportuntiy to address it again, the Court will use langugage broad enough to strike down all race-based preferences.
How much more of this can we take??????? After just three months, we can’t recognize our own country.

Let’s see what the Supremes say about this!
Does this now include farmers who raise pot? Hope not.
