I agree. I pity the police on this one, and many more. This kid reaped the results of his actions. 2:30 AM, running from the cops with a gun in your hand. That police officer likely saved future lives. If I were his parent, I would mourn but would not blame the police. Kid was feral, and had been for a long time most likely.

The way our brains work, the cop thought the suspect still had the gun. He saw the suspect draw the pistol, but the "toss" occurred behind the suspect's back, where the officer could not see it. In his mind, the suspect still had the gun. Magicians use this "feature" of our brain to fool us with sleight of hand. I suspect the suspect was also trying to fool the cop by tossing the gun behind the fence.
In a split second, this is a very difficult shoot/don't shoot decision. I suspect most people would have shot.
Good find. So it was literally LESS than a second from the time the officer saw the gun down by the kid’s waist in his right hand and the kid simultaneously spun, tossed the weapon (done so while that action was out of the officer’s field of view) and pulled his right hand up from his waist to his front and the officer fired not perceiving that the gun was no longer in the kid’s hand.
The kid did a stupid thing and paid for it with his life. Justified shooting, IMHO.

If the cops KNEW he had a weapon and if the cop did not see him dispose of it then when the kid made the sudden move to turn around the cop was and should have been in fear of his life.

Yup. Judging by the cops natural instinct to sidestep away when the suspect turned, he definably thought he could have got shot, too. That alone clears the cop from wrongdoing after knowing the delinquent was armed. See #230

Yes it has validity. The copnsaw a gun, issued an order, saw hand movement.
It’s a matter of interpretation.
Some say the cop made a rational and conscious decision in a split second, “good shot”.
Some say the cop shot someone who was very obviously run out, panicking, but nonetheless in the process of complying with the cop’s instructions. Which plays to the “institutionally racist cops” narrative. Some will view it as just the most recent case of a random black guy getting shot by white cop despite doing exactly what they’re being told to do by that cop.
I’m in neither camp. It was not a conscious, considered decision to shoot.
It was preceded by a trained “muscle memory” defensive move by the cop. We all see that. So, subonscious reflex. Shot may have been like a follow-on knee jerk response.
Upthread someone said I’ve never been in that position. Quite right, I’m not a cop chasing down an armed suspect. But I have had people waving weapons in my general direction, even while doing first aid.
I’m not professionally trained for that, my reaction is totally involuntary. My reaction to a sudden gun/knife threat is to take a split second to scan the armed guy and work out if he’s really threatening anybody or just posturing / howling at the moon / trying to show he’s in charge. Depending on the threat level I’ll ignore, divert, or talk the guy down - without stopping first aid.
Other legitimate involuntary responses can be freeze, fight or flight. It’s a personal thing. Good training and discipline should creaye a “muscle memory” which will help make the gut response more tailored to certaincircumstances.
There’s something wrong with your cop training if some cops in that chase situation are still scared enough to shoot from the hip and others can calmly assess the threat level while still chasing the suspect.
This cop was chasing the kid for some time. He had far more than a split second to figure out the likelihood of that kid shooting him. What I see in the vid is a split second decision..
but it’s preceded by several seconds to assess the threat and preempt the suspect’s move.
Danger point: gap in fence, possibly other gang members nearby. Mitigation: kid himself was run ragged and unless he’s Wild Bill Hickock he ain’t gonna pull off the perfect back hand reach around and hit the cop. Solution: stop a distance away, shout order to stop and raise hands... And watch the... Floor, or hands???
Cop was watching the floor for a dropped weapon, and possibly shot because he didn’t see a dropped weapon. So say his advocates.

Anyone with a basic knowledge of how human eyesight works knows we’re primed for reacting to left/right movement. Gray/black things dropped vertically from hip to floor in poor light are far less likely to be spotted.
If your cops don’t know this, their training sucks.
Because they are going to do that anyway, I may as well enjoy it too.
