MADISON, WI - Wisconsin's Supreme Court is striking down Gov. Tony Evers' statewide face mask mandate.

The 4-3 ruling was issued in a 78-page decision Wednesday morning.
Republican lawmakers filed suit in October on the mandate.
They said the governor did not have the authority to extend the state's public health emergency beyond 60 days without approval from the legislature.
Wisconsin's current mask mandate is set to expire Monday after Evers signed a new emergency order Feb. 4.
That came hours after the Republican-controlled Assembly voted to repeal a previous order that included a statewide mask mandate.
The court's decision does not affect any local mandates that remain in place.
Evers said a decision on whether not to extend the current mask mandate will be made at the last minute.
What they’re saying in their ruling is that Evers did NOT have the authority to extend the mask mandate beyond 60 days, per our Wisconsin Constitution.
The Gov has 60 days to get an ‘emergency’ under control by whatever means necessary, but THEN he MUST get the approval of the State House and Assembly (Senate) to extend plans, go any further, make more demands upon the Citizens, extend mandates already in place, etc.
Evers just kept issuing ‘emergency orders’ with NO approval from our Legislature...who DID take this all the way to our SC, which pleasantly surprised MANY of us.
I’ll bet you a doughnut that other state Socialist Democrat Governors did this, too.

Nonsense. You had 60 days to go to the legislature and get an actual law passed. If you can’t do that, then it’s the government’s own fault that it is “ineffective”, not the fault of the constitutional restraints placed on the governor.

They all did. In Illinois, one county court struck down the Governor’s continuing use of “emergency powers” after the deadline, and nullified all of them, but he just ignored that and kept issuing orders anyway, and all of the government agencies just pretend they are valid somehow.
“Evers declared a state of emergency on March 12, 2020. The legislature never extended it. Accordingly, any orders issued by the Governor more than 60 days thereafter are unlawful and void. While a pandemic will not follow the laws of men, the Governor must.” -
