He’s toast, unfortunately. He got out of his vehicle. He could’ve driven away. Then he pulled his weapon and just brandished it.
Also, he’s carrying a handgun without a round in the chamber. I get the arguments for and against this practice, but this video shows very clearly that he was visually compromised and he had to rack the slide to chamber a round. If he was being actively attacked, he’d be disarmed, seriously injured, or dead.
Actually, if they painted his windshield, he might not have been able to see to drive away. However, the Oregon authorities will not see it that way.
And yes, if you are carrying a pistol for immediate self defense, you need to carry it with one in the chamber so it is ready for immediate action the second it clears your holster. You may have to shoot someone off you, and begging them to give you time and your other hand free to rack the slide isn’t going to work well.
Brandishing is not illegal in Oregon.
But liberal DAs will still find a way (e.g. Strickland).
While I carry and recommend carrying chambered, I dont criticize someone for carrying the way he did. At least he was carrying.
As to brandishing, he seemed to react to either being maced or being struck with something thrown, so his reaction to address a threat is also appropriate.
Sometimes people are too critical of others when they havent been confronted with the situation faced by those being criticized.
On the other hand, the best way to win a gun fight is to avoid it. There will be no ‘winners’ in an armed confrontation.

Good analysis. The only hope he has in the Soviet of Oregon is jury nullification. But it the trial is in the liberal capital of the State, he has little chance of that.
