Biden administration misses its own deadline to issue workplace mask standard

The Biden administration missed its self-imposed deadline to issue temporary mask standards for workplaces as the Occupation Safety and Health Administration tries to determine whether an emergency order is needed to protect workers from the coronavirus, according to a report.

President Biden in an executive order on Jan. 21 directed the government “consider whether any emergency temporary standards on COVID-19, including with respect to masks in the workplace, are necessary, and if such standards are determined to be necessary, issue them by March 15, 2021.”

So they’re trying to use OSHA as a backdoor to force national compliance with their mask mandate, regardless of what the states decide to do.

All it will take is one woke snowflake in every business to file an OSHA complaint and your business will be bankrupted if you don’t comply. Find an excuse to fire those snowflakes now while you still can, is my advise to business owners.

Maybe they didn’t miss the deadline. It said if needed it would be by March 15.

Their problem is that there are existing OSHA regulation prohibiting extensive wearing of masks except in extreme environments, such as spray painting and sand blasting.

Exactly and there are few businesses that would not fall under OSHA directives. I suspect OSHA would extend the mandate to anyone inside the business including customers at Walmart. If so, this will be about as popular as the old 55 MPH federal mandated speed limit. It’s the sort of thing that could generate a gigantic backlash.

But, as we say “Down South”, Biden can take a flying leap at a rolling doughnut.

If OSHA imposes a mandate like this, the office workplace will disappear forever. So will conferences, seminars, company events like office parties, etc.

OSHA will be loathe to issue a regulation unless there is a NIOSH standard behind it. There is no NIOSH standard for surgical masks. Surgical masks intended to protect the patient are covered by the FDA which refers to ASTM F2100. FDA regulations for respirators intended to protect the wearer from particulates refer to NIOSH N95.

I have a feeling that OSHA would like to stay as far out of this as they can, and I can just about guarantee that the ground level inspectors want nothing to do with it. (I was a safety manager in a very hazardous industry for 20 years. I dealt with OSHA.....a lot.)
