A few years ago SCOTUS ruled,in "Caetano v Massachusetts" that weapons commonly in use today qualify for Constitutional protection despite the fact that they weren't in existence on the day that the Constitution was ratified.

I'm no Constitutional scholar but it seems that a bill like this would be struck down by the courts.

And BTW...the vote in the Caetano case was 9-0.
