News2Share has obtained previously unreleased footage of a July 7, 2020 incident in which ATF Agent James Burk attempted to make contact with a member of the Columbus, Ohio community, who then called 911.
When Columbus PD officers Joseph Fihe and Kevin Winchell arrived, Agent Burk did not comply with their commands, even at gunpoint. The officers tased Agent Burk in the process of subduing him.
Agent Burk - who in 2015 was charged with shoplifting wine from a Kroger grocery story - is now suing the officers for excessive force.

My verdict. Agent Burk is a belligerent sob who is lucky to be alive.
Didn’t gas him and then burn him alive, the ATF standard for reasonable force (as established in Waco, TX some years ago). Therefore, not excessive force. GTH ATF agent.

I was pulled over a couple of times while still working in in law enforcement. The first 2 things I said were to ID myself as an off duty cop, and that I was armed. The third thing I said was “officer, what would you like me to do next?” It let them know I was compliant and they were the ones telling me what to do, and not the other way around. I never had a problem. This guy is an ass.

When they interview the woman and son you can see she's shaken. It sounds like he was strong arming her and trying to get inside.
It was the right move to close the door and call the police.

If one thinks this ATF guy is bad news, one should try one of the FIB agents. They think they’re god.
It is protocol, whenever a cop goes into an adjacent jurisdiction they notify the agency in advance. That way when complaint calls come in, or gun shots are fired, the city knows there’s a cop at that location. For some reason this clown apparently did not do that.
Thaaaat’s a shame.
I have no love for ATF or their tactics but those two cops are straight out of Idiocracy.

Also, despite today’s hit movies and TV shows, the Officer in the uniform is the unquestioned boss on the street. Everyone on day one of plainclothes training is told that... clearly.
Being armed, in street clothes, and giving the man in uniform a hard time is a good way to get your lamp blowed out.
You don’t know what you’re talking about. Armed man say’s “I’m a federal agent”, refuses to obey any instructions, and wants to reach into his pockets for an ID? Gets increasingly belligerent? And is there by himself?
Typically that should have been a two man job. Him being there alone is even more weird.
He was either arrogant as a fed, or was exceedingly poorly trained.
They go to a 911 call about someone trying a home invasion. They arrive and find a solo guy who is armed and won’t do a single thing they say but says he’s a Fed.
Believing that on face value from an uncooperative man is a good way for a cop to wind up dead. And every plainclothes guy knows that fact *in spades*.
This tells me ATF and other FLETC types are constantly being told they are somehow superior to local police and to carry that movie mentality.
I didn’t see him get arrogant until after he had taken quite a bit of unwarranted abuse from that nutso cop.

The guy was up to no good; trying to get into that home.
He got caught trying to do something either on his own or with instructions from others. The question is what.
Yep. Any cop taking enforcement action in street clothes should expect to be treated like a criminal until all information can be gathered.
