An attorney for former President Donald Trump said he won’t bring up claims about election fraud while defending the former president during the upcoming impeachment trial.
“There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it,” attorney Bruce Castor told KYW Newsradio Philadelphia. “President Trump has plenty to win with what he has.”
Castor also pushed back against reports that Trump parted ways with his initial legal team about whether they would advance his claims about election fraud.
“I don’t know where people got that notion that was some sort of litmus test to get to defend the president, because as you saw from the document I filed, which had to be approved by the president personally, there isn’t anything in there about the election being stolen,” Castor said.
Castor and fellow Trump lawyer David Schoen filed a response to House Democratic impeachment managers on Feb. 2, arguing that the impeachment trial is unconstitutional because Trump doesn’t currently hold office. They also argued that Trump has a First Amendment right to express his views about the accuracy of the election results.
Democrats argued that Trump’s speech wasn’t constitutionally protected and said it incited an insurrection at the Capitol on Jan. 6.
“Just because somebody gave a speech and people got excited, it doesn’t mean it’s the speechmaker’s fault—it’s the people who got excited and did what they know is wrong,” Castor said in pushing back against Democrats, referring to Trump’s remarks to a crowd on Jan. 6.

Isn’t the charge that PDJT instigated the riot by talking about the stolen election?
I think their evidence is the speech itself - and there is no evidence there.
That’s certainly a factor to consider. Hopefully they will have prepared a condensed presentation to hit the major points within the time allowed.
According to Giuliani, Epshteyn, Bannon, and others, they’re backing away from the speech on the 6th. They know there’s nothing there, and the timeline refutes it. Now they’re collecting his body of speech over the years and using that. Don’t know if it’s true but what I heard on War Room a couple times.
I hear you. You could be right about Trump and the advice he is getting.
But ... (you knew that was coming) I don’t think either your solution or mine has any chance of success without Trump in the lead. I assume you agree.
Right now Trump is at least mum on the 3rd Party issue. If he goes for it I will certainly support him. But I really do not expect him to go that route.
And I have to reemphasize my disappointment in his decision to not. present evidence of fraud at the trial.
That seems to be the "core issue" of President Trump's problem.
The ADVICE he's been given by far too many of the people he has surrounded himself with is designed to compromise him and sink his ship.
This sham impeachment is designed to destroy Mr. Trump's future and his ability to be a LEADER.
If this impeachment silliness FAILS I honestly believe they'll attempt to assassinate him.
Trump frightens the hell out of the swamp and the deep state because he has so much POWER with the people simply because of the ideas he "sells" to the American public and how much they LOVE him for it.
Good question. The answer probably has something to do with MASSIVE CORRUPTION in both parties.😡
Was my first guess as well.. I truly can’t think of anything else that makes sense of it.
Then it’s a waste of effort. Start Plan B; buy ad time and pages on any media willing to sell it, and lay out the evidence for all to see.
I am hoping not only that team Trump focuses squarely on the stolen election - but also that President Trump himself makes the presentation, in all its gory detail.
He can call his witnesses and show videos, but do most of the talking himself.
If he does this, it will be the most watched program in the history of TV by far - and it put the anti-Trump forces in a bind.
With the whole world watching, any attempt to suppress evidence or block him from fully making his case will make them look guilty as hell. Which they are.
