Amazes me how many commenters have reading comprehension problems. The applicant IS NOT a citizen NOR a permanent legal resident. It states this very clearly in the article.

So, what is the issue? It is common for people to not be hired into sensitive positions because they are not citizens. When I used to hire people, I *only* hired US citizens. I'm pretty sure that even our interns had to be citizens. This was in a DoD facility.
I'm certain that Elon Musk has a lot of sensitive projects going on, considering that his SpaceX company works closely with the government. Most likely his company cannot legally hire non-citizens. This lawsuit will be thrown out.

I watched a video where Musk was on a stage somewhere and he was asked why he doesn’t hire non-U.S. citizens. He answered it was because U.S. law forbids it due to the sensitive nature of the information involved. IOW’s, because SpaceX works with NASA and uses NASA launch pads and other equipment. We’ll now see Bidumb and his Ho allowing foreigners access to OUR tax supported infrastructure due to Marxist agitation.
Yes, Musk does get money from the taxpayers AND he supports the ACLU.

Exactly my thinking, especially if the position in question was in a sensitive federal project. The contract might even have a restriction on what citizen status the personnel had to have.
I would think that if the applicant had the correct visa to work in the US, they would have stated such in the article.
If Elon wants to go to Mars, he’ll have to “sell out” to the Leftists. Or hope Texas declare for independence.
Elon Musk may win this one. SpaceX has government contracts that require a security clearance where the government dictated that he can’t hire people who won’t pass a background check.
