For the same reason Chief Justice John Roberts refuses to sit for the Trump impeachment farce, all Republican Senators should also refuse to be seated. There is nothing the damn democrats could do about it. Trump is now a plain, non-political citizen and not subject to impeachment which is meant to remove an office holder from office. It has no other function. The democrats are using it to punish Trump for getting in the way of their awful platform.

After they got what they want — they got rid of TRUMP — then it’s “OH No, can’t do that... it’s non constitutional!” to make them look ever so virtuous and lawful. This is all a scam. Everyone should be impeached or hanging on a rope. I don’t think I can take anymore depressing news about criminals — that’s what they are — for 4 years. Everyday it will be some more bad and depressing news by this criminal organization and the upshot is... nothing is done about it. I might as well have been reading the Uganda newspaper for the next 4 years about what a great guy Idi Amin is and all the wonderful torturing and butchering that is taking place. Biden is the sock puppet of Obama who is the real present day Idi Amin of African despotism.

So they are beating you over the day every day and you read the news and it is beating you over the head every day and nothing gets done. Maybe that’s a great thing. People are not losing their liberty and life over freedom because most people are still well off and semi free. Why fight when you are well off? But I don’t care to read about it.

There should be a section on FREEPER about good news. News that is taking taking the fight to Biden and getting things done. 4 years of bad news from all the corrupt institutions like the Republicans and Democrats, the media, the courts, the DOJ, the FBI, etc.... is too much.

The constitution says “...Impeachment shall not extend further than to removal from Office, AND disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States...” The emphasis on AND is mine. It is important because he is neither in office nor can he be disqualified from future office. He would face a civilian trial should evidence of his guilt be sufficient, which it is not. He told protesters to peacefully and lawfully let their voices be heard.

I think it’s very simple. Roberts declined because it’s not an impeachment. Trump isn’t in office.

Chief Justice John Roberts’ refusal to preside over former President Donald Trump’s second impeachment trial is raising questions about whether he views the first-of-its-kind proceedings as constitutional.

I believe it is Chief Justice Roberts' view that impeaching a private citizen is unConstitutional and therefore he has removed himself from the proceedings. It cannot be any clearer.

The US Senate can only conduct trials of the president and civil officers.

The Senate has no power to try private citizens.

If he is tried as president the Chief Justice presides.

Your law library must be in your sit sack.

Trump actually should continue to be President, and this is why the current crop of socialists, globalists, and fake-climatologists want to make sure he is really deposed, with no possibility of returning even if/when their theft of the right to reign is unmasked, reproved, and the rightful election outcome is put in place.

This seems to go beyond simple recusal.

I think JR recognizes his “bias” in that he feels the case is unconstitutional. His “bias” isn’t about the defendant’s potential guilt or innocence. It’s about the charge itself. On that basis, he might (possibly) decide the case in favor of Donald Trump. Since that outcome is unacceptable, JR steps aside so that someone who is more likely to find the defendant guilty can be found. And they found a Democrat who is already on record thinking that Trump is guilty before the trial starts. An ideal judge, in other words.

If that is his view and the reason why he declined to preside, then Roberts should say so publicly. To not do so is extremely damaging to the nation and the Constitution he swore to uphold. He is taking the coward’s way out, but then he never has exhibited much bravery in his career on the court.

Yeah- would expect that from a bunch of plagiarizers without one original thought... especially not the ORIGINAL thoughts written down as our US Constitution w/ or without Amendments.

It is not going to be pretty. Studying up on the FDR attempt to stack the Court- which was stopped by Americans of both parties. Especially by democrats in the South who knew what an a@@hole FDR was, dragging us into war as we were coming out of the financial economic crises his manipulations perpetuated.

It is the bringing of charges that is the impeachment process, not whether one is convicted or found innocent of the charges. He was impeached, but not even brought to trial of the charges claimed, let alone found not guilty of the offense claimed,

On one hand we have people saying Roberts must preside because Trump was impeached while in office

On another hand we have people saying the trial does not count because Trump is a private citizen and you can only do this for somebody in office.

On another hand we have a senator who filed impeachment charges against Joe Biden for acts he committed when he used to be in office.

The Constitution does not say “must”; it says “shall”. That’s it in a nutshell. Any attempt to get around this wording is unconstitutional in itself. Plain and simple.
