Senator Rand Paul @RandPaul The Senate just voted on my constitutional point of order.

45 Senators agreed that this sham of a “trial” is unconstitutional.

That is more than will be needed to acquit and to eventually end this partisan impeachment process.

Be careful here - all we know is that 45 Senators think it’s a sham trial and almost certainly will vote no.

We don’t know the reasoning or how the other 5 will vote...yet. In fact, it’s possible that some of Trump’s actual supporters (which are probably no more than 5 in the Senate, anyway) want Trump to have his day in ‘court’...although very unlikely.

It just goes to show you what geniuses our current crop of former lawyers turned politicians are. They couldn’t make it in their chosen profession. So, they turned to politics where their epic lying, cheatin’, and a lack of morals isn’t an issue, even for lawyers. ;?)

“The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.”

“Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”

Article I, Section 3

The “removal from office” text suggests that impeachment only may only be applied to officeholders. Trump has left office.

Nancy and her ‘rats could have voted to impeach Trump the day after the Capitol incident. I think the legal term is laches.
