Sen. Rand Paul says that a Senate impeachment trial of former President Donald Trump that doesn’t include Chief Justice John Roberts would be an illegitimate process.
“If Justice Roberts won’t preside over this sham ‘impeachment’ then why would it ever be considered legitimate?” the Kentucky Republican tweeted Friday. “Hint: It won’t be.”
Later in the day, Paul joined Fox News’s Sean Hannity and elaborated on his impeachment stance, calling it an “illegitimate procedure” if Roberts isn’t there.
“It isn’t a real impeachment. It’s going to be a fake, partisan impeachment,” Paul said about a process without Roberts.
“The story is,” Paul continued, “that the chief justice is not going to be asked, but the reason he’s not going to be asked is he’s privately said he’s not supposed to come unless it’s an impeachment of the president.”
“So, this is an illegitimate procedure,” he said. “And even the chief justice of the Supreme Court, who's not a rabid Trump person, who's actually, if anything, sort of in the middle, he is now saying this is illegitimate because I’m not getting in the middle of this and I’m not coming over for this.”

The constitution gives them no power to impeach a person who is not a sitting president.

The operative word is “otiose.” An impeachment trial for an ex-president is empty of all meaning and value. The Constitution’s plain reading (and not a Pickwickian reading) is that the power of impeachment rests in Congress for the REMOVAL of a president. No President — no Removal.
A possible analogy is a decree of divorce after one spouse has died: no wife or husband, no divorce. It’s really that simple.

These people are controlled by their visceral hatred of Mr Trump. Nancy’s and Chuck’s emotions, and those of many other (s)elected representatives and senators, have gotten away from them. Constitution, what’s that? Faithfully protect and defend the Constitution? Something is very wrong as these **stards not only claim that they are, they will denounce anyone questioning them as enemies of the country.
The Supreme Court has shown that the document is irrelevant many times during our country’s history, and many have suffered a loss of liberty as well as died as a result of its holdings.
The near term focal point now comes down to CJ Roberts - will he or won’t he? Perhaps by avoiding to allow cases on election fraud and unconstitutional actions by several states he thought it was all clear sailing on a sunny day in a post Trump presidency. Maybe Schumer can threaten Roberts with physical harm as Chuck apparently got away with it last time he threatened 2 justices.
While the Constitution may allow you to disqualify a criminal from running again, it’s never been done to a president in our history and it is the stuff of dictatorships - especially when the president hasn’t committed a crime.
Democrats are out there saying “why n he might seek office again!” Where are the Republicans lined up to scream “Tyranny!”.
They’re talking about throwing red state Congressmen out as well.
All over a Constitutional vote challenge and one demonstration. We’re all to lose our jobs and be labeled domestic terrorists as well.
This is not a free America. Why the Hell aren’t Republicans saying it?
They all know they have a ripe turd on their hands they are looking for the proper way to dump it. Giving Trump a platform to defend himself would be a huge mistake and they know it. Even going after Trump via his businesses is a big mistake because he can play the victum. The Biden administration is already in full destruct mode. The first few days have been a disaster and it’s all downhill from here. They stole it, they can’t control it, protect your investments.

Has anyone considered the reason for the dogged push to impeach Trump is that if the truth is admitted, and the dems did steal the election, then Trump is actually still president? If he is still the prez, then that explains their eagerness to impeach him again.
