From paragraph 2 of the Articles of Impeachment (Round 2): “In the months preceding the Joint Session, President Trump repeatedly issued false statements asserting that the Presidential election results were the product of widespread fraud and should not be accepted by the American people or certified by State or Federal officials.”


Any fair trial must address the factual nature of this claim - air the evidence, in detail. I’ll buy the popcorn.

The trial is illegal. Under the Constitution it is an illegal Bill of Attainder.

Conviction by the Senate won’t happen, and the Democrats know it. The hideous, old baboons and their pet weirdos only want to publicly scold Donald Trump as long as possible. They’re so caught up in their fantasy, that they don’t realize how ugly their spectacle is.

If true, and I generally take Rand Paul with a grain of salt, then it’s an indication of how Roberts will rule when the whole matted of whether the impeachment trial of a former president is even constitutional reaches the court.

Nobody has standing.

Donald Trump is not president, That was taken care of on Jan 6th, by both sides, and approved by congress and the senate.

If congress votes to convict a normal citizen that is prescribed against in the US constitution, that is the role of the judicial. The “penalty” and “the conviction” congress can put forward would be unconstitutional.

Wonder when biden going to wake up to the fact he is the one whos power is being taken.

You could have various charges drawn up on dead Democratic Presidents (probably even President Jackson, and President Theodore Roosevelt.

With the way the Taliban-left is actively erasing historical figures, this isn’t a bizarre notion...

I think the reason Roberts is ducking this is because he expects the impeachment to be challenged later. When that case reaches the Supreme Court, he would have to recuse himself if he had presided over the trial. He especially doesn’t want that because he would then lose an opportunity to vote against Trump when it really counted.

If anything, Trump could try to pre-empt this by appealing now to the Supreme Court on the grounds that he's a private citizen and impeachment is moot. That would put Roberts back into the hot seat to accept or deny hearing the appeal, since he oversees the DC Circuit Court.

Since Trump 1) still has cases pending before SCOTUS contesting the election, and 2) can still challenge the election through the writ of quo warranto, Trump's argument will be that he is the legally elected president and because Roberts refused to show up, the trial is illegal.

Correct. If it included former presidents, it would have been written: when “a” president is impeached.

Funny how this point has gone under the radar. If the Supreme Court had done it’s job, we wouldn’t be where we are. This is on them. Tyrannical movements never retreat. Acquiescence only emboldens such movements.

So the decision will only be 5-2 rather than 6-2 against Trump. Or maybe he feels he would need to participate to counter any argument from Alito or Thomas that our three spineless cucks should show some spine and follow the silly little screed they swore an oath before their white racist God to follow.
