In NYS they are. Our legislature gave Cuomo carte blanche in March and has yet to rescind it.
You are right for the most part, but governors wield more authority than Tony. The three branches play out in the States, too, with a tension that, hopefully, prevents a slide into tyranny, NY, CA, and IL notwithstanding.

you’re drawing a distinction without a difference...an ‘edict’ which is aggressively enforced by moral suasion (try going into a public place unmasked, and watch weasly employees and customers descend on you) is every bit as onerous as any duly legislated ‘law...’

In Wisconsin, the State Supreme Court twice ruled the governor’s edicts unconstitutional. People voluntarily isolated and masked, anyway.
We have no foundational law any longer. Every commie just ignores them.
We should, too. Keep notes when commies violate and get a pass. Use that when at trial to assert unequal protection.
