Photo Credit: Google Maps More than 150 Pennsylvania businesses were warned this week that they will be facing more serious repercussions for defying COVID-19 restrictions.
The restrictions close indoor dining, gyms and theaters until Jan. 4, but businesses already crippled by the pandemic say they can't afford to lose any more cash, and that they can safely stay open.
The state's Department of Agriculture on Wednesday implemented a new set of enforcement actions for noncompliant restaurants, subjecting them to unannounced inspections, citations of up to $300 for each day they remain open and then -- if that doesn't work -- temporary closures.
"Failure to comply will result in enhanced penalties upon revisit and referral for criminal prosecution for obstructing the administration of law or other government functions, pursuant to the Pennsylvania crimes code," the Department of Agriculture said.
"Restaurants that are violating the law are endangering public health through activities that pose significant risk for spreading the virus at a time when hospitals are near or exceeding their capacity to treat infected patients."
A spokesperson with the state of Pennsylvania said a vast majority of Pennsylvania businesses are following the time-limited mitigation orders, and local police departments have discretion whether to warn or cite an establishment for violations.
Bucks County District Attorney Matt Weintraub said he prefers that his county's 39 police chiefs focus on emergency response fighting crime rather than enforcing COVID-19 restrictions.
Many Bucks County residents have been expressing concern over defiant gyms and restaurants, County Commissioner Diane Ellis-Marseglia said Friday.
She said state police are the ones that "need to respond," and urged struggling businesses to "contact us, ask us for help, ask us for direction."
This week, Pennsylvania's State Police Liquor Control Enforcement officers issued 17 warnings and 11 violation notices, the Philadelphia Inquirer reports.
The West Main Diner in Lansdale is among several local restaurants that are openly noncompliant.
Some customers are in full support, saying the longtime establishment has been hurt enough. Others say their support has been lost.
"They are defying the Governor’s Order and jeopardizing the health of the community, their employees and customers," one person commented on the West Main Diner's Facebook post. They are breaking the law... we will no longer frequent your restaurant."
Just below it, another person backed the diner, saying: "If you are not comfortable with the situation at hand then don’t go. For the ones that are comfortable that is there[sic] choice. I would much rather see these restaurants try and make the best out of a very bad situation and keep there doors open instead of permanently closed due to financial issues."
Consumers with general food safety complaints or concerns about non-compliance for COVID-19 mitigation can file a report online.

It’s not. Think they want a vast underclass solely dependent for the working for the slave labor companies of Amazon, Kroger, McDonald’s and Walmart. No small businesses mean this. The sweat equity and life savings of millions of small business wiped out.
At the same time, millions of dot Indian foreign scabs has killed off the white-collar middle class.
Over 50 million aggregate working Americans lost at least some or most of their pay this year. From solid middle class to begging for handouts, yet not one lying, stinking Indian went back home to India (in fact, while other countries earned travel bans due to the Coronavirus, India was the sole country that didn’t face a ban.
Pennsylvanians have to be patient, focused, and committed to making lasting changes. The executive branch in PA has far too much unchecked power and in the hands of petty tyrants Wolf and Levine, they’re playing it to the hilt.
Other than civil disobedience at this point there’s not much the general population can do because the legislature won’t rein in the governor and the PA supreme court is rubber stamping whatever Wolf and Levine direct.
Every election, no matter how minor, has to be treated as critical until the balance of power is back in the hands of the citizenry.
In the mean time, I’m sure there are snitch lines that are open for people to report whenever they see a Dem politician getting an illegal haircut or sitting down for an illegal meal.
It ends when people collectively stand up and say, "¡Basta! Enough!"
Sue the state, the governor and his queer transgender health expert.
If enough business owners stand together and refuse to do what the commie politicians demand, there is not enough law enforcement or National Guard to enforce it.
This all makes sense as long as the common perception is that the US national debt is imaginary and it’s okay to keep printing money. It’s been 60 years since the last time the US national debt decreased from one fiscal year to the next (year ended 12/31/1960), and we have even changed “year-end” twice. When the national debt becomes a real thing, maybe the ruling class will have to stop spending money we don’t have; maybe not.

I would shred up the statement saying that I owed a fine and burn the pieces if I was getting shut down.
I made a specific point to patronize one of the defiant restaurants when I was in PA last week.
I thanked my waitress for her defiance and left her a 90% tip.
These executive orders are not law. Citizens are under no compunction to follow executive orders. None.
My home state just instituted a quarantine rule when crossing the border. When I get home in two weeks I’ll be sure to comply. Yea right.
You can’t logically call closures “temporary” when there is no real end-date and there are no pre-announced metrics for the ending whereby business owners can PLAN.
