Throughout 2020, America has faced a global pandemic, civil unrest after the death of George Floyd and a contentious election. As a result, an influx of fear about the possibility of the invocation of martial law or unchecked military intervention is circulating around the internet among scholars and civilians alike.

“The fear is certainly understandable, because as I’m sure you know, martial law isn’t described or confined or limited, proscribed in any way by the Constitution or laws,” Bill Banks, a Syracuse professor with an expertise in constitutional and national security law, told Military Times. “If someone has declared martial law, they’re essentially saying that they are the law.”

What is ‘martial law’

In short, martial law can be imposed when civil rule fails, temporarily being replaced with military authority in a time of crisis. Though rare, there have been a number of notable U.S. cases where martial law came into play, including in times of war, natural disaster and civic dispute — of which there has been no shortage in 2020.

While no precise definition of martial law exists, a precedent for it exists wherein, “certain civil liberties may be suspended, such as the right to be free from unreasonable searches and seizures, freedom of association, and freedom of movement. And the writ of habeas corpus [the right to a trial before imprisonment] may be suspended," according to documents from JRANK, an online legal encyclopedia.

Martial law may be declared by both the president and by Congress. State officials may also declare martial law, according to the Brennan Center for Justice, however, “their actions under the declaration must abide by the U.S. Constitution and are subject to review in federal court.”

Will it be a nightmare? Maybe. But I look at it this way: It’s along the lines of that old phrase, “you can pay me now, or you can pay me later.

The Civil War was a nightmare, but not as bad as it would have been if we had just acquiesced.

My view is that Trump will do no such thing. He’s been constantly accused by his opponents of being dictatorial. Other than the use of executive orders Trump has pretty much run his administration under federalist principles. He let the states run their own COVID response. He didn’t really push any regulatory action against Social Media despite the provocation they offered. He has been a constitutional president. I think Trump is banking of the USSC making a ruling that will count the Republican electors from the disputed states. If he doesn’t get that ruling, it’s over.

Only if the plan for martial law involves the arrest, charging, trial conviction, and sentencing of the governor, mayor, state attorney general, county/city DA, police chief, and/or election officials responsible for the lawlessness, violence, election corruption, and treason within that state or city.

A fraudulent election for President of the United States sounds like a pretty dam good reason to. Multiple criminal acts occurred including foreign interference in our electoral process.

I would be in favor of any action that exposed the plotters of this coup. I could name them, but we all know the usual suspects.

I would like to see some serious TV time devoted to explaining the steal and how it happened, and a new election scheduled.

Our biggest issue is that elections and election laws are no more respected than the personal foul rule in sports. But, if we started kicking out a few and arresting some, that might change.

Just like the poll workers in Pennsylvania , Michigan and Georgia, you catch us and... so what? Anybody questioned under oath?

At least they spelled “martial” correctly. I am dismayed at how many FReepers spell it as “marshall,” as if old Marshall Dillon is going to run things.

Declaring martial law is a complete NO GO, a pipe dream fantasy. There would ZERO support for it in Congress, impeachment would be an absolute certainty, and I’d bet there would be enough rhino GOP senators to push it through.
