Pennsylvania Republicans on Friday asked the U.S. Supreme Court to review their claims that Pennsylvania violated the Constitution by allowing anyone to vote by mail.
Rep. Mike Kelly (R-Pa.) and other party members, including congressional candidate Sean Parnell, filed the suit last month, over a state law enacted last year.
“Act 77 is the most expansive and fundamental change to the Pennsylvania voting code, implemented illegally, to date,” the suit stated, describing the law as “another illegal attempt to override the limitations on absentee voting prescribed in the Pennsylvania Constitution, without first following the necessary procedure to amend the constitution to allow for the expansion.”
A Pennsylvania judge said the plaintiffs would likely succeed and blocked the state from certifying the results of the Nov. 3 election but the Pennsylvania Supreme Court struck down the injunction days later. The U.S. Supreme Court earlier this week denied a request for immediate relief.
Petitioners responded by filing an emergency application for writ of injunction, or an immediate stay, pending the filing and disposition of a petition for a writ of certiorari, or a review of the Pennsylvania Supreme Court ruling.
“The basic framework of our democracy forbids the dilution of votes and the devaluation of core constitutional tenants. Procedural gymnastics aside, the central issue in this case is that Act 77 is unconstitutional under the Pennsylvania Constitution and, therefore, a violation of the U.S. Constitution,” attorney Gregory Teufel, lead counsel for the petitioners, said in a statement.
Teufel accused the Pennsylvania Supreme Court of having “shirked its most basic responsibility” to determine whether a state law violates the state Constitution.

Where is everyone? Few posts/comments tonight.
Was hoping for something from my legislators.
Mastriano and Kelly are good.

Most likely, stepping outside to get their collective breaths back.
Come what may, millions are disappointed with the new SCOTUS folks.
Those millions are around the world, not just on FR. :(
I told my beloved husband that if Biden or Harris are sworn into office there will be no pity on my part for any American who voted for them and gets harmed as a result.
Video and photo evidence of fraud exists, no doubt about that. Hundreds of sworn affidavits, too.
Is the Scrotus constantly trying to dodge and dismiss all these cases on procedural grounds, “standing”, etc., so they won’t have to tell 75 million patriots “Yeah, we saw all that evidence, but we can’t do anything about it, sorry...”?
Is it now the duty of the SCOTUS to dodge its responsibility to decide issues of Constitutional caliber? If so, then why do we need them?
Alan Dershowitz believes they just didn’t want to have to deal with the election and come up with solutions.
Sounds cowardly to me.
Its moral cowardice
Without a criminal case against named defendants - indictment of suspects accused of criminal vote rigging and perp walks in front of the cameras - no court or legislators will overturn the vote.
All these technical legal issues, like in Kelly’s lawsuit, should have been filed before the election. The courts are not going to undo the results after the fact based on wonky nerdy arguments that certain procedural changes weren’t enacted by the right government body or through the correct process.
They didn’t need to come up with a solution. Just like Bush versus Gore, they can send this back to the legislatures in the individual states as this suit comes up and tell them to fix it since it was misappropriated by the executive branch and the courts.
“Lacks standing”
wait for it.. it’s coming.
Part of the brilliance of the Founders was giving Federal Judges lifetime terms. Politicians are beholding to the electorate, Federal Judges are not.
Seems many hate Judicial activism by Liberal Judges but it's ok if done by Conservative Judges....
Very happy to see that there are still some fighters left on our side. The sheer number of doom and gloom fatalists voicing “all is lost” is quite disgusting. If the fate of this country was left to them our cause would indeed be lost.
Well it is Saturday...and otherwise activities such as Christmas shopping etc. are in swing. I for one have stayed away from the news channels this weekend.... needed a break.
I understand.
I would have been screaming and filing, from the moment the various SOSs were screwing with the system.
Guessing the republicans thought we had more than enough votes for Pres Trump, or thought it wouldn’t matter who’s president as long as their own rice bowls are full. :(
I think they have lost hope. I think many are absolutely shocked at how quickly SCOTUS gave all of America the middle finger. I am very disappointed but not surprised in the least.
I have said for a long time we waste too much time trying to get the "right" judges on the court. SCOTUS is not going to save this country. We are going to lose every meaningful case.
“...Mastriano and Kelly are good. ...”
So is Daryl Metcalf. Fighters...
Do they really need the useless SCROTUS to tell them what they have the constitutional obligation to do?
Yes. We need to send them suport.
but I still believe in trump....
