Attorney Alan Gordon from Chenango County, New York, told a state Supreme Court Justice on Tuesday that the county found 55 uncounted ballots for the 22nd Congressional District, adding a variable to an extremely close race.
In the district, Republican candidate Claudia Tenney led by 12 votes over Democrat incumbent Anthony Brindisi. The newly found votes may decide the result of the election.
Gordon said election officials found 44 valid ballots, with 11 ballots not cast by registered voters. He’s advised the county’s Board of Elections to secure the ballots and keep them unopened in their offices.
Gordon told syracuse.com that he didn’t get additional details from the county election officials and he presumes the ballots were from early voting.
“Those ballots were apparently mislaid and never counted,” Gordon wrote in an email to Justice Scott J. DelConte.
On Election Day, Tenney led Brindisi by more than 28,000 votes, with a 10 percent lead and the majority of votes counted. But after counting absentee and affidavit ballots, the margin shrunk to 12 votes.
Gordon asked DelConte for instruction regarding the ballots, as DelConte told the 8 counties in the district not to modify the votes they submitted on Monday. Herkimer County had corrected its total on Sunday by adding 10 more votes to Brindisi and 35 more to Tenney.

TOTALLY unbelievable that votes become “lost”.
Heads need to roll.
Sesame Street’s Count had this concept all under control years ago.
I believe Chenango County is rural and more conservative. Brindisi would have to win 70% of the 44 valid ballots to win.
I don’t think he can do it. I think the GOP will have 213 seats in the next House, five short of capturing the speaker’s chair.
Keep the faith!
They need to be thrown out.
Election Day has passed.
Too bad...so sad. /s
If Tenney wins she will be number 213.
They pull this in election after election...
No one really cares...
It is clearly ok with the sheeple...
RE: Once again extra Democrat ballots found.
Remember how Al Franken defeated Norm Coleman in Minnesota for the Senate in 2008 ? He initially lost, then forced a recount, lost again, and then another recount and finally “found” enough votes to win — by 312 votes out of nearly three million cast (a margin of just over 0.01%).
We’re seeing a repeat of this schtick once again this year.
The USA doesn’t need another Speaker in the mould of PRyno...
trump won Chenango county by about 3;2. Very unlikely Brindisi can pull enough votes to overcome Tenney’s 12 vote lead.
You’re assuming that the ballots are from real voters who haven’t voted already. That’s highly doubtful, given that it’s in New York.
Recent article have said there are still 2000 ballots to sort through. Ballots that were contested, and Provisional Ballots.
These are all part of the huge mail in vote fraud. Those have massively favored the cheating democrat.
I don’t believe there was any county where the mail in ballots came in anywhere close to favoring the republican. Not even in the counties where she did great with in person voting.
That is because mail in voting is full of massive fraud.
Led by 28,000 and it SHRANK after mail in and other made up votes to 12. And the media want us to believe that no voter fraud is happening!
If he can’t do it, another few dozen votes will miraculously be discovered
Horseheads is nowhere near Chenango County. At least 90 miles or so away.
Counties out West cover that mileage and more quite easily. It's in the Southern Tier.
"a town in Chemung County, New York..
" They both start with a "C".
Some peeps down there need to wake up among Horseheads...
She was up by 28,000 votes.
This is being stolen from her.
More Rat cheating as they “find” enough ballots to put their guy ahead. The GOP should magically “find” just as many ballots. Does anyone really believe that these are legitimate ballots.
