Pennsylvania Supreme Court dismisses lawsuit against mail ballots with prejudice in another defeat for Trump

The Pennsylvania Supreme Court dismissed with prejudice a Republican lawsuit seeking to invalidate more than 2.5 million votes cast by mail in the general election, the latest in a string of legal defeats for the GOP as President Trump fails to undo his losses in key battleground states.

Justices on the state high court ruled unanimously late Saturday that Republican petitioners waited too long to file their suit challenging Act 77, the 2019 law that established universal mail voting in Pennsylvania. Trump allies had asked the court to invalidate all votes cast by mail in the most recent election or direct the majority-Republican legislature to choose a slate of presidential electors. The ruling with prejudice means that the plaintiffs are barred from bringing another action on the same claim.

The court’s written order called the latter option “extraordinary,” noting that it would disenfranchise 6.9 million voters.

Amazing how they ignore the turd in the punchbowl of whether Act 77 is Constitutional. IMHO that is the issue.

They are merely defending their unconstitutional actions and in the process disenfranchising 6.9 million million voters.

Here’s my understanding. The PA legislature can intervene or not, depending on their political and legal views on the subject and independent of the lawsuit and the PA supreme court. Two: the fact that the PA supreme court made a quick decision and did not run out the clock allows Trump to take the matter to the Supreme Court earlier, rather than later.

If the intent of the PA Supremes was to harm Trump, they actually did the opposite, by allowing Trump to appeal to the SCOTUS. I suspect that although the best move on their part, in order to harm Trump, would have been to table the case until later, they wanted to send an angry, emotion laden message that,”Orange man bad!”

Don’t you just love how Trump is living rent free in their minds?

There was no doubt as to how the Pennsylvania Supreme Court would rule. Mail-in ballots are their baby.

In another development, Al Capone dismissed all charges against himsel for racketeering, murder, and running a mob crime famiy.
The Pennsyslvania Supreme Court are the ones who broke the law by extending mail in ballots in the first place. They can't make judgment against their own unconstitutional ruling. This is a nothingburger.

If the republicans...conservatives...took to the streets and burned all down till the judges saw our way.... would they ever?

PA is liberal in courts and cities? where are the coal people.. where are the people Trump saved their jobs and saved them....where are they??!!

We really shouldn't be upset by this. It has been many years since I had civics and I really don't keep up with the news, so I had to research this. Apparently this is covered by the 28th Amendment. This was the amendment that Obama passed as an executive order. He was the first president to do so. It was upheld by the Supreme Court of the United States by a 5-4 vote with Justices Roberts and Ginsberg writing the majority opinion.

AMENDMENT XXVIII - Originally proposed Jan. 29, 2009. Ratified Feb. 1, 2009. Courts shall have to power to tell you to stand in the corner. Constitutionality is anything deemed necessary by Courts. Corps are not to be confused with Courts or corpse. ☪

For you constitutional scholars, this amendment is often referred by its clauses: 1.) The standing clause, 2.) The deeming clause, and 3.) The Corps or Marine clause. Also for you history buffs, this amendment is popularly known as the emoji amendment. While controversial with some right-wing conservatives, most Americans applauded Obama's use of the crescent moon emoji for showing solidarity with Sharia law. This is thought by some in academia to be one of the highlights in Obama's legacy.

President Trump went to court about two problems: First, only a handful of Republican observers—substantially fewer than the Democrats had there—were being admitted to the room at the Philadelphia Convention Center where inspections were being conducted. Second, the few who could get in weren’t permitted to get close enough to see what was actually happening. The most important questions all have to ask are: Why all the hiding? What’s being hidden?

At the Convention Center counting location, I personally observed dozens of Trump campaign volunteers being barred from the counting room even though they’d been properly registered as observers. That’s why I urged Pam Bondi and Corey Lewandowski, who were on the scene, to authorize the filing of a request that a federal court order the Board of Elections to stop this nonsense.

More hiding: despite a binding order of the state’s Commonwealth Court, the handful of Republican observers who could get into the room weren’t being allowed up to the barrier set at six feet from the closest tables where work was being done. So even though they were in the room where it was happening, they had no way to tell what was happening. If there’s no fraud, why is the Democrat-controlled Board of Elections unwilling to let people get close enough to actually see what its people are doing?...

Uhhh yeah. The Pennsylvania Supreme Court is an elected body and currently has a 5-2 Democrat majority. This was always going to be the outcome. Going through the state court in order to appeal to the US Supreme Court was always the plan and a necessary step along the way.

This is just WAPO being WAPO.
