§2381. Treason Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.

So scroll down to 2382. Basically, if you know of treason (see section 2381), and don't report it, you are also guilty ....but, doesn't seem like you can get death penalty.

I have to ask: media and social media. Do they know of people "adhering to our enemies"? Do they know of the movements of Dominion? Of things on Biden's laptop that tie him to the Communist Party of China?

Just asking the question :)

This is not treason, not in the legal sense of that word. We are in a declared war against any enemy, so by definition “treason” cannot occur.

Look at Section 2384 - this is sedition.

Treason is treason and the method by which it is done is immaterial. It is all punishable by death or imprisonment.

Well, as far as I know none of this can be linked to North Korea. But that would be nice if it could be done. I believe we’ve been in a declared war with North Korea for longer than I’ve been alive. Other than that, I think it’s mostly our allies trying to overthrow our government.

Enforcement of this code requires an AG willing to prosecute and secure convictions. We've always been told that we a nation of laws and not men. Unfortunately, that is no longer true.

How does a President, who finds out there was coup against him, get people prosecuted? Can he order it? Order the DOJ, like Barr, to issue warrants?

What protection does a President have when DOJ, Legislature, Judicial branches run a coup against him? His recourse?

I don’t believe that we ever declared war on NK. That was a UN police action (an animal that the Founders never even thought about, that’s how alien of a concept it is). That NK and SK are in an active (legal) state of war is beyond question...but the US and NK are not (to my knowledge) in a state of war, nor have we ever been.

No one, to my knowledge. The last nation that we were legally in a declared war with was the Japanese Empire, and the state of war ended on 9/2/1945.

That’s the extent to which the government has subverted the Constitution - because we’ve lost about 100,000 dead and probably 10x that many wounded, and spend literally trillions of dollars, doing very war-like things without a formal declaration of war. I could understand an emergency situation, like the Soviets having launched missiles at us, that there isn’t time to officially declare war, but with Korea, Vietnam, Iraq (twice) and Afghanistan there was PLENTY of time to officially declare war after the initiation of hostilities.
