Trump campaign asks Pennsylvania court to declare Trump winner

President Trump's campaign filed a lawsuit on Wednesday over election results in Pennsylvania, arguing that he should be named the winner in the battleground state and that the GOP-controlled state legislature should be given the authority to assign its electoral votes, according to multiple reports.

The suit also argues that the campaign’s constitutional rights were violated because observers were not given adequate access as election officials processed mail-in ballots.

The claim was dropped in an earlier version of the lawsuit.

WE need a score card to tell what’s going on. I thought the PA Supreme Court ruled against Trump on this.

The Pennsylvania state legislature was given that authority in the Constitution. I sure hope the Trump campaign hasn’t decided to delegate that authority to the Judicial branch.

The Founding Fathers knew what they were doing. They designed our presidential election process to prevent interference from the British crown, but the process if followed can also prevent interference from the Chinese Communist Party.

Whether a number of Pennsylvania elections accommodations in light of the coronavirus pandemic – providing additional drop-off sites and alleviating signature-matching requirements for absentee ballots, as well as lifting a restriction on employing out-of-county poll workers – violate state election law and the U.S. Constitution.

I think the lawsuit asks the court to give the state legislators the ‘go-ahead’ (i.e. ruling that there are so much ‘irregularities’ that the election’s validity is in doubt, so the state legislators should do what they are constitutionally authorized to do.) to appoint R electors for Trump

There’s a better chance of them declaring Jesus himself the winner.
It’s clear that there was manipulation but it does not seem that any of the white hats have found the smoking gun.

Not sure that I trust this wording from the Hill to really be what Trump's campaign is asking for but... No court should declare Trump the winner of any state; nor should a court declare Biden the winner of any state; that's not the role of a court. My hope for the courts is to acknowledge there was fraud and perhaps to throw out the fraudulent votes if they can be separated from valid votes, but I'm skeptical that can be done at this point.

This is not the court's authority to give; the U.S. Constitution Article II provides that state legislatures already have this authority and they don't have to ask Mother-may-I from the courts or their state's Governor. In case you didn't know, you have no Constitutional right to directly vote for the president.

I still say that it’s a mistake to even imply that the Judicial Branch has any say in whether or not the Legislative Branch can exercise its Constitutional authority.

This gets to the entire purpose of the separation of powers. One of the great failings of Trump’s first term was the tendency to defer to improper rulings from rogue federal judges. Ridiculous rulings that should have just been ignored created years of delays as appeals were filed.

The Judicial Branch has no more power or authority than the Executive or Legislative Branch. We might just as well ask the legislature to pass a bill giving the Supreme Court permission to make a ruling.

I think the judicial branch does have a say on whether they deem the evidences presented cast doubts on the election’s integrity.
They probably will not rule outright that the election is invalid, but they can pass it back to the state legislators to do the job by giving them the SC’s own ‘reasonable doubts’ as to the integrity of the election.

In other words, we are trying to get the ‘opinion’ from the SC to guide and incentivize the state legislators to carry out their constitutional duty

What’s going to incentivize state legislators is lots of furious constituents demanding that they overturn this blatant fraud. The Executive Branch declaring Insurrection and taking action against foreign agents interfering in our elections will also be helpful.

If the Supreme Court doesn’t want to issue an opinion in this matter is that the end of it? Do they get to hand the presidency to Biden?
