The flawed, fractured and possibly inaccurate spectacle of ballot-counting to which Americans have been treated as Pennsylvania became the focus of the 2020 election deserves all the challenges President Donald Trump is throwing at it, according to a group of Republican attorneys general.
Democrat Joe Biden has been declared the winner in Pennsylvania, but the Trump campaign is raising serious questions about how the votes were counted. Rudy Giuliani, Trumps lawyer, on Sunday said the number of challenged ballots is so high that it could flip the results.
Supreme Court Justice Samuel Alito last week ordered state officials to keep separate ballots received at Pennsylvania elections offices after the polls closed.
With that as the backdrop, Missouri Attorney General Eric Schmitt filed an amicus brief with the U.S. Supreme Court in the Trump campaigns effort to ensure that mail-in ballots that arrived after Election Day are not counted.
Schmitt was joined by the Republican attorneys general from Alabama, Arkansas, Florida, Kentucky, Louisiana, Mississippi, South Carolina, South Dakota and Texas.
Trumps campaign is suing to overturn a Pennsylvania Supreme Court decision allowing mail-in ballots postmarked by Election Day to count, as long as they arrived by Friday.
The Pennsylvania Supreme Courts decision overstepped its constitutional authority and encroached on the authority granted to the Pennsylvania legislature, the filing argued.

It specifies in Section 7:
“(ii) An absentee ballot cast by any absentee elector as defined in section 1301(i), (j), (k), (l), (m) and (n), an absentee ballot under section 1302(a.3) or a mail-in ballot cast by a mail-in elector shall be canvassed in accordance with this subsection if the absentee ballot or mail-in ballot is received in the office of the county board of elections no later than eight o’clock P.M. on the day of the primary or election.”
And then we have
“Section 11. Sections 1, 2, 3, 3.2, 4, 5, 5.1, 6, 7, 8, 9 and 12 of this act are nonseverable. If any provision of this act or its application to any person or circumstance is held invalid, the remaining provisions or applications of this act are void. “
When the PA Supreme Court struck down the requirement of Section 7, it triggered the “nonseverability” clause.
My impression is that the US Supreme Court could rule that, when the PA Supreme Court struck down the deadline, it also struck down the authorization for mail-in ballots.
It remains to be seen as to whether the Supremes have the guts to say that.

To Hotspurs point....can the state legislatures and the Supreme Court say what was done is unconstitutional and thus a fraudulent election...so the state legislatures can appoint the electors.
PA and the other states, I believe, have Repub legislatures who can award their electors.
Trump wins; the Supreme Court has spoken.
Clarence Thomas and Brett Kavanaugh are leveling the playing field for what was done to them.

Shows total digital manipulation across multiple state from a command center somewhere, perhaps China or John Brennan’s or Gina Haspel’s basement. Perhaps even Barack Obama’s impenetrable brick fortified house.

But think this will be resolved. Somewhat from reasons other than this Supreme Court case.

I think it’s at a point where if a legislature insists on appointing electors based on their election legislation not being followed, the Supreme Court would uphold that appointment.
I doubt the Supremes would reach out and literally do that on behalf of a legislature that hasn’t tried itself.
But in point of fact, we’re at a place where it looks like PA may be about to certify a slate of electors selected unconsitutionally; indeed, in direct contravention of the explicit constitutional words and even kind of in the face of a clear warning on October 28 from a faction of the Supremes.
Still anyone’s guess where it goes from there. It’s more a matter of institutions and institutional prerogatives and overall good of the country than “voter fraud.” But PA did flout a Supreme Court warning and probably an order, and the law is clear. That’s where we’re heading, in probably about two weeks, and the pressure on the Court either way will be monumental. Indeed, all the jumping ahead by the media and Biden is to put that kind of pressure on the Court. They may just punt. They may hold firm.
