Two months ago, I detailed Trump’s powers under the Fourteenth Amendment, which grants the President the power to declare an illegal insurrection against the United States of America and strip Electoral College votes from states which are engaged in a coordinated insurrection.

And somebody put up the links today to contact a lot of these legislative people in those swing states. Damn it I should have copied the listt. now I have to go find it today to email those places.

We have got to put pressure on these people

Probably not.

But the Supreme Court could weigh in....look at five to seven states, and just say the process cannot be ‘fixed’, declaring the voting in those states as unreliable.

In the case of Penn, the state legislature has the power to vote the EC people themselves. I’m thinking that the Supreme Court might to the House solution....letting them vote in January (state by state) and that would put the whole weight (burden) upon the court system and the House to resolve the mess.

Lets be honest....among both left and right, confidence is now shaken and I can’t see how we’d come up in four years to trust this to work (as advertised).

I’m also of the mind that a dozen of GOP ‘stars’ would really like Trump gone, and go back to the uni-party concept. Maybe it’s time to go create two additional parties, and let forty-percent of the public escape the Republican and Democratic mess.

Unfortunately these legislators, well all of government for the most part are all in on this!
I hope the last weeks of President Trumps term he goes scorched earth and unleash everything.
America is toast and yes I’ve given up, mainly because of the deafening silence from the people we’ve elected into office. I’m truly sad for my kids and their future.

The state legislators, unlike the Fed.gov congress are relatively “clean”.

China has yet to drill down far enough with “silver or lead” on these guys.

By 2024 they will have tho

I doubt Trump alone has that authority, but section 3 of the 14th amendment does contain a section disqualifying electors for president/VP who have engaged in insurrection or rebellion. I’m not sure who makes that determination, but I would assume it to be the courts.

I’m not a lawyer but IIRC there are at least a few...if not more than a few...states where the state legislature has the power to name the Electors that will vote on the day the Electoral College votes (sometime in December).But I can’t swear to that.

Find Mark Levine’s podcast from yesterday he lays everything out. The problem is the RINOS in these legislatures.

Well this is what the 14th amendment Section 3 actually says:

Section 3.

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

14th Amendment

So I am not sure if a president can just arrest them, but maybe so.

Well, yeah, if there is an insurrection the President can do all sorts of things, just look at what Lincoln did after the Civil War.

But that’s basically only going to work if the states are in open war against the government, which is a case that’s going to be very hard to make, since they haven’t actually fired a bullet.

The problem is, you can argue maybe the fraudsters counting the votes are “in insurrection”. I doubt you could argue it convincingly, but you can at least argue it because they are openly doing something to undermine the government.

But the electors are the ones you would need to make the case against, and there isn’t any evidence against them.

It's Section 5: The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

That points to the missing piece to the puzzle. What, if any enabling legislation on this, either from its reconstruction era passage or since, exists and what does that say. That can be used NOW. No new legislation regarding it is politically possible during this crisis.

And Congress includes the combination of House of Representatives and the Senate. So are you saying the President can indeed use the insurrection act here to refuse usage of the ballots from those states?
