The Constitutional issue here is clear, at least to me.

If the Pennsylvania Legislature provided for extended counting in their provisions for appointing Electors, it’s Constitutional under the Federal Constitution.

If this extended counting was ordered by a court, any court, and it violates the Pennsylvania Legislature’s SOLE POWER to appoint Electors, then it’s unconstitutional.

That was going to be my question - thanks....I would expect that this will be the case in quite a few of the cases to be heard soon...Of course that’s not how Lemon CNN will see it.

Last night he said that the president doesn’t WANT ANY VOTES TO BE COUNTED - he conveniently forgot to add - AFTER November 3!!!!! He’s the creep of all creeps!

The minute you talk to anyone, you learn exactly what news outlets they are listening to - verbatim points from the night before!

Every state has the authority to develop their won election laws, without interference, unless they violate the constitution.

An extension of the timeline to count their ballots is wholly within the purview of every state.

“Alito wrote that it would be “highly desirable” to decide the case before the election and that there is a “strong likelihood” that the Pennsylvania Supreme Court ruling violates the Constitution.

“But I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election,” he wrote.

In addition to an expedited schedule, Republicans had asked the Supreme Court to order Pennsylvania to keep ballots that are received after Nov. 3 separated. Pennsylvania told the justices earlier on Wednesday that it will do so voluntarily.

Alito wrote that nothing prevented the GOP from asking the Supreme Court for relief “if, for some reason, it is not satisfied” with the assurance provided by the state.”

No they didn’t. All the hysterics here can go back to your meds.

They said they would review it later. PA agreed to sequester ALL ballots received after 11/3. This is a huge win. It gives the court time, with ACB, to review in and bring it up again with being damaged by the late ballots.

My court guy, Zen Master, is fine with this ruling and has never been wrong.

Not a ruling on the merits of the case, but only for expedited review. Ballots returned after Nov 3 will be segregated, so basically any ballots that arrive after Nov 3rd are in jeapardy of being tossed, pending a final ruling by SCOTUS.
