MD: Jury acquits Pasadena man of murder, says he acted in self-defense on his property
Capital Gazette ^ | 26 October, 2020 | Alex Mann

An Anne Arundel County jury on Monday acquitted a Pasadena man of murder, manslaughter and felony firearms charges, agreeing that he acted in self-defense when he fatally shot an acquaintance who drove to his home despite warnings and then charged him.

The verdict came hours after prosecutors and defense attorneys finished their closing arguments to the panel. Prosecutors said the homeowner was too quick to open fire on Jeffrey Dickinson. Gregory Korwek’s defense attorneys said the 44-year-old left him no choice.

When the jury issued its verdict, Korwek began crying and hugged his attorneys. Then, he embraced his wife. Simultaneously, Dickinson’s family members huddled together with their heads bowed.

“It’s an incredible feeling of relief that he was found not guilty of these charges,” defense attorney Peter O’Neill told The Capital after court. “We still recognize that it’s a tragedy that Mr. Dickinson died ... we pray for [him] and his family.”

O’Neill maintained throughout trial that Korwek was justified in shooting and killing Dickinson, who arrived at Korwek’s house in Pasadena drunk, disgruntled and after making threats.

“If it’s not justified under these facts... then there is no right to use self-defense,” O’Neill told the jury.

So prosecutors say he acted too quickly? Sounds like what the Burn Loot Murder crowd says about cops who have to shoot young (and not so young) punks who resist arrest, try to take the cop's gun, etc.

A homeowner doesn't have to wait for an attacker to fire the first shot...and neither does a cop.

But I guess with cops all they're allowed to do is "shoot him in the leg"

“Prosecutors suggested Korwek was eager to unleash a blast from his shotgun, rather than hunker down and wait for the police to de-escalate the dispute.

“Deadly force is supposed to be a last resort, not a first impulse,” Assistant State’s Attorney Jason Steinhardt told the jury.”

I guess this is the difference between a red-state prosecutor and a blue-state prosecutor, along with the laws in those types of states. In Texas, while they will investigate every shooting of this type, you don’t need to worry about being arrested if someone with bad intentions steps into your house (and usually you’re good if they’re on your land or messing with your car).

<“If it’s not justified under these facts... then there is no right to use self-defense,”

This is where the Anti-2A's have been focused for decades. Move the line that proscribes "Self-Defense" into a place where you're no longer legally able to defend yourself or your family.

In the Peoples Republic of NJ, we are obligated to "retreat" when faced with life-threatening violence. Failure to do so is punishable under NJ statutes. I pray I never need to find out, but will defend myself and my family at any cost.

Wait for the police? What are they going to do? Outline your body in chalk when they arrive.
They man did the correct thing. He shot to kill. They taught us to always shoot to kill. Later in court, it’s your word against his and if he’s dead it’s still your word against his. You never want to get in the situation where you have to defend yourself in court against a cripple.

Putting the Pasadena man on trial for an obvious case of self-defense was prosecutorial abuse.

I suspect there was pressure for him to plead to a lesser charge, or else it was a warning sign of intimidation to others who would use their 2nd Amendment rights to protect their own lives and the live of their families.

Shouldn’t have even gone to trial IMO. Was the dead guy black?

You can beat the rap, but you can’t beat the process. The prosecutors got most of what they wanted out of this.

“...and traces of fentanyl and cocaine were found in his urine.”

They made the dead guy pee in a cup? That’s cold.

Yep, the process is the punishment. Which is why gun owners need insurance to cover legal defense.

And 2A supporters need to start a non profit organization that is dedicated to providing top tier defense lawyers pro bono for this type of prosecutorial abuse.

Like fightback.com is doing for Kyle Rittenhouse.

LOL I see another who doesn’t read. ;-)

Even the headline indicates state. And the first sentence should make you hesitate when it states “Anne Arundel”.
