I don’t see how the prosecution or defence could ever certify such a thing. It raises the standard from beyond a reasonable doubt to a certainty. Even a full confession doesn’t meet that standard.
Forced into a plea by the FBI who changed his interview. He did it because they were threatening his son. The whole entire Flynn saga was based on FBI abuse to begin with.
There is no gag order on Flynn according to Powell.
And what happens if DOJ does NOT certify by Monday.
Nope. The DOJ will need an extension. If they don’t meet the deadline, the judge can toss it, and then sentence Flynn.
This jerk is going to force an appeal and/or A pardon.

In what way did he lie to Pence? Just curious as to what you base that on. What is your evidence that he did so?
I expect that your answer may be “Because he accepted the plea deal offered to him” but wanted to be sure.
There’s actually no gag order but evidence has been sealed which serves the same purpose.
The gag order misunderstanding started with his brother mentioning a gag order to a group they were meeting with. The brother likely meant case evidence was sealed so General Flynn probably couldn’t say much about the case when speaking to them.
The FBI can work amazingly fast and accurately, lime when they analyzed tens of 1000s of Hillary’s emails in 48 hrs proving no violation of any security rules or laws just in time for the vote in 2016. Some of their most impressive work to date (that we know of)
There are many people (including some here on FR) who accept as evidence that General Flynn lied Flynn’s acceptance of a plea bargain.
They don’t consider the factors that you stated, that they bankrupted him, lost him the ability to be employed, and threatened to charge his son (who had an infant son at the time) with crimes.
It is just yet another “delay” in the guise of “Let’s make sure that this thing will not go away until after the election.”
This doesn’t mean they will comply. The FBI has a looong history of doing whatever the hell they like.
The government (DOJ) has already told the Court and the Attorney General that the entire case was a fraud, without merit. For that reason, the DOJ has determined that they will not pursue this prosection and have requested the leave of the Courts to dismiss the case. Nothing in this case can be trusted, it was a frame up. Sullivan knows that, what he wants to proceed with himself in the role of the prosecutor. Of course, he cannot do that, the Constitution has said that such a thing is a no no.
His Democrat masters told him to delay this case until after the election and this is just the latest rabbit that he has pulled out of his hat (more likely, his ass).
