Republicans to push ahead with U.S. Supreme Court pick despite Democrats' boycott

U.S. Senate Republicans pledged to go ahead with a vote on Thursday (22 Oct) on President Donald Trump’s Supreme Court nominee, Amy Coney Barrett, despite Judiciary Committee Democrats pledging to boycott a proceeding that they called “a sham.”...

All 12 Republicans on the Judiciary Committee have indicated they will support Barrett, a favorite of Christian conservatives, while all 10 Democrats are opposed. Graham is thus thought to have enough votes to prevail, but might have to circumvent some committee rules on doing business with no Democratic members present.

Assuming the Judiciary Committee sends the nomination to the full Senate with a favorable recommendation as expected, Senate Majority Leader Mitch McConnell aims to hold a procedural vote on Barrett’s nomination on Sunday, which would limit debate so that a final vote to confirm her could occur on Monday.

12 to 10. It is a formality at that point.

That said, awhile back in Texas there was an attempt in Harris County to increase property taxes and they did not have a quorum, the 2 Republicans did not appear. The Democrats on Commissioner's Court were trying to ram through a tax hike in violation of “the rules”.

Steve Radack and Jack Cagle, the two Republican members of the Harris County Commissioners Court, blocked the approval of the largest property tax rate increase in a generation by being absent from the court's meeting Tuesday.

...Texas law requires that at least four of the five court members be present in order to vote on a tax increase, as News 88.7 reported on Oct. 7. Since Cagle and Radack were not present when the tax increase item came up, there was no quorum and no vote.

The proposed tax increase would have raised Harris County's property tax rate to 65.26 cents per $100 assessed valuation, up from the current rate of 62.998 cents per $100 assessed valuation. This is the last year in which Harris County could raise property tax rates by such an amount. Under a new Texas law, local governments will only be able to raise property taxes by a maximum of 3.5%. Anything higher will require them to go to voters for approval.

Since there was no vote, the property tax rate will decrease to the effective tax rate of 61.17 cents per $100 assessed valuation, according to the Harris County Budget Office...

They’ll be there to do all the political grandstanding they did last time with Kavanaugh. The “boycott” Schumer is talking about is for the Judiciary Committee, not the full Senate.

One theory for the Dems boycotting the the committee, is so they can later justify packing the Court, by claiming that they have to, because Republicans changed the rules, to “pack” ACB first.

Alternatively, they might just be pandering to their rabid base, for fundraising and enthusiasm.

The committee vote is nothing but a formality and is only done under Senate rules. There is no reference to a “Judiciary Committee” in the Constitution.

There you have it. It's Graham that's circumventing the rules - not the Democrats refusing to show up for a hearing on a committee for which they are members.

Have McConnell just call a floor without even having a committee vote. Don't even give them a chance to grandstand. Not like they won't hold their press conference anyway.

No democrat need be present for the vote to take place.

Senate Rule XXVI.7(a)(3):

The vote of any committee to report a measure or matter shall require the concurrence of a majority of the members of the committee who are present. No vote of any member of any committee to report a measure or matter may be cast by proxy if rules adopted by such committee forbid the casting of votes for that purpose by proxy; however, proxies may not be voted when the absent committee member has not been informed of the matter on which he is being recorded and has not affirmatively requested that he be so recorded. Action by any committee in reporting any measure or matter in accordance with the requirements of this subparagraph shall constitute the ratification by the committee of all action theretofore taken by the committee with respect to that measure or matter, including votes taken upon the measure or matter or any amendment thereto, and no point of order shall lie with respect to that measure or matter on the ground that such previous action with respect thereto by such committee was not taken in compliance with such requirements.

Judiciary committee rules: 9 members including at least 2 members of minority are considered a quorum for transacting business.

“McConnell should tell Schumer that if the Democrats boycott the Judiciary Committee vote this week (the committee needs at least two minority party members to conduct business), he’ll move to shut down the 30-hour debate window on Sunday/Monday and go right to a full Senate vote at 8:00 on Monday morning.”

actually, it’s probably better that the Dems boycott the committee vote ... would love to see them boycott the full Senate vote as well ...
